The following interview was audio digitally recorded: On March 11, 2015, at approximately 1300 hours, was standing on the upper level balcony of his apartment building watering plants, when he saw a white pick-up truck stop in the roadway on South Main Street facing northbound, with several Santa Ana Police Department (SAPD) cars stopped behind it. The suspect vehicle initially stopped in the roadway due to traffic stopped in front of it. SAPD officers were able to clear the other vehicles from the area; however the suspect made no attempt to drive his vehicle away. heard officers yelling commands multiple times to, “Put down the gun” in both Spanish and English. saw one officer take a position of cover behind a tree directly across Main Street, pointing a rifle at the ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION INTERVIEW REPORT S.A. 15-005 Investigator: ERIC WISEMAN Approved By: Date of Report: 03/18/2015 Date: 04/07/2015 Page 2 of 2 suspect, later identified as BENITO OSORIO. Other officers began to position themselves around the suspect vehicle. The suspect vehicle was stopped in the roadway for approximately 10 to 15 minutes, when heard the sound of one shot coming from inside. Immediately after the one gun shot, heard officers relaying information about what they were seeing OSORIO doing. Officers stated that the suspect still had a gun and that he may have a cellular telephone in his hand. After approximately five more minutes passed, OSORIO opened the driver side door and exited his truck, with a gun in his hand. then heard the sound of multiple gunshots fired by police toward OSORIO. said that it sounded like just one gun shot, because all of the officers fired at approximately the same time. had moved from the balcony to a position in the doorway leading into the apartment building, so he could not see where OSORIO went after being shot by police. later stated that when OSORIO exited his vehicle, he could only see the driver door open and could not see OSORIO, because he was on the opposite side of his vehicle. stated that he did not actually see a gun in OSORIO’S hand when he exited his vehicle. Officers immediately approached OSORIO and paramedics quickly arrived and began providing medical aid in an effort to save OSORIO’S life. OSORIO was put into an ambulance and transported from the scene.
