HomeMy WebLinkAboutInt Osorio Rosa by McShane_Redacted SA 15-005 CASE NAME: OSARIO, BENITO CLASSIFICATION: OFFICER INVOLVED SHOOTING (FATAL) INTERVIEW OF: ROSA ORALIA OSORIO PRESENT: CHUCK ELMS, DETECTIVE SANTA ANA POLICE DEPARTMENT DATE AND TIME: MARCH 11, 2015 1745 - 1807 HOURS LOCATION: SANTA ANA POLICE DEPARTMENT On Wednesday, March 11, 2015, at approximately 1745 hours, I conducted an interview of ROSA OSORIO, regarding an officer involved shooting involving the Santa Ana Police Department (SAPD). Also present for the interview was SAPD Investigator CHUCK ELMS. The interview was audio digital recorded. There was one short break in the middle of the interview at 1747 hours, so that I could accept a telephone call from my immediate supervisor, MARK GUTIERREZ. The interview started again at 1750 hours. The interview ended at approximately 1807 hours. When the interview was over and the recording was turned off, ROSA OSORIO provided Detective ELMS and I with additional information at which time I turned my recorder back on. The time was approximately 1807 hours, and the conclusion of the interview ended at approximately 1830 hours. The following is a summary of the entire interview: ROSA OSORIO was married to BENITO OSORIO for the past twenty years. ROSA was unaware of any problems in their marriage and /or with BENITO’S physical or mental health. ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION INTERVIEW REPORT Investigator: C.MCSHANE #320 Approved By: Date of Report:04/10/15 Date: 04/20/2015 Page 1 of 3 SA 15-005 ROSA and other family members often refer to BENITO by the name of “BENNY.” ROSA and BENITO had lived together for the past five years, at their residence on Keller Avenue in the city of Santa Ana. BENITO worked as a production manager for Ink’s Print, located in the city of Irvine. ROSA worked at NWP Service Corporation in the city of Costa Mesa. ROSA and BENITO had two children together, ages seven and eighteen. ROSA was not aware of BENITO having any relationships with any women outside of their marriage. She also denied having any relations with any men outside of their marriage. Other than work related stress, ROSA was not aware of BENITO having any personal or financial problems or any problems with anyone. ROSA said she and BENITO were very close with their family members. She described BENITO as being a very loving and caring father and husband. ROSA was aware of the fact that BENITO has owned a hand gun for the past six years, which he had for protection and kept in a closet, in their bedroom at their home. ROSA did not see the gun very often and was unable to provide any details or a description of the gun. ROSA did not see BENITO leave the house this morning with the gun. Earlier today at approximately 1130 hours, ROSA left work and returned home for lunch. At approximately 1230 to 1245 hours, ROSA received a telephone call on her cellular telephone from BENITO. BENITO told ROSA, “I’m sorry, I got in trouble” at which time the telephone disconnected. ROSA immediately called BENITO back; however, it took four separate attempts before her call went through. On the fourth attempt, the call went through; however, there was no one speaking or acknowledging her on the other end. The telephone line remained open. ROSA could hear some unknown type commotion, people talking and the sounds of “an ambulance” in the background. ROSA heard someone say, “He’s still breathing, he’s fine.” ROSA could hear someone breathing heavy; however, that person was not responding to her. Investigator: C.MCSHANE #320 Approved By: Date of Report:04/10/15 Date: 04/20/2015 Page 2 of 3 SA 15-005 ROSA began screaming into the phone for “BENNY” to answer her; however, neither he nor anyone else did. Anticipating that something was occurring at BENITO’S place of employment, involving BENITO; ROSA immediately responded to his workplace in the city of Irvine, to further investigate. At the location, ROSA learned that BENITO was not there. ROSA contacted BENITO’S boss, HAROLD who told her that BENITO had left the location earlier in the day indicating that he was heading home to have lunch with her. ROSA was confused and unsure of what was going on with BENITO at that time. ROSA was unable to determine what BENITO was referring to when he told her that he was in trouble. She could not figure out why or what had taken place that would have caused him to be in trouble. Detective ELMS advised ROSA that BENITO had been involved in a shooting incident earlier in the day. It was alleged that BENITO had shot at another person and as a result of the police contact, which occurred immediately after the shooting, that BENITO had shot himself and at the police which resulted in his death. ROSA was asked if she knew anyone by the name of ALBERTO MENDOZA HERNANDEZ, the victim that BENITO had shot at prior to the police contact, and she said, “No.” ELMS asked ROSA if she knew anyone by the name of JANET, and she said yes. ROSA had found that name on BENITO’S cellular telephone approximately five years ago. At the time, ROSA confronted BENITO with the name. Although BENITO denied having an affair with JANET, he told her that his relationship with JANET was over and ROSA said that was the end of it.
