On Wednesday, March 11, 2015, at 1250 hours, I received a telephone call from Santa
Ana Police Department (SAPD) Sergeant GERRY SERRANO who advised of an officer involved
shooting incident that occurred at 300 South Main Street, in the city of Santa Ana. Sergeant
SERRANO requested the Orange County District Attorney’s Officer Involved Incident
Investigation Team, respond to the location and conduct an investigation into the incident.
I notified Orange County District Attorney Investigators DEAN FULCHER, RYAN SMITH,
CHRIS McSHANE, DOMINGO CABRERA, SUSAN FRAZIER, VIVIAN TABB, BRUCE LINN, MIKE
KENDRICK, and ERIC WISEMAN and requested they respond to assist in the investigation.
At 1513 hours, SAPD Sergeant JEFF SMITH conducted a briefing of the known
circumstances surrounding the incident for personnel involved in the investigation. The
following was learned from the briefing and preliminary investigation:
On Wednesday, March 11, 2015, at 1250 hours, Santa Ana Police Department officers
received a call of two males fighting at 819 South Cypress Street, Santa Ana. The reporting
party also stated that a gun was discharged during the altercation and a male subject was heard

stating he had a gun; and a male Hispanic adult was seen fleeing the area in a white Toyota
truck. Santa Ana Police officers responded to the area and located a white Toyota truck bearing
license plate #7X06303 leaving the area. The truck travelled north on South Main Street from
West Chestnut Avenue and stopped in the #2 lane of South Main Street. Numerous marked
Santa Ana Police units arrived on scene and parked south on the Toyota truck.
The suspect, later identified as BENITO OSORIO, ignored the commands of the police
officers on scene and refused to exit the truck. OSORIO then armed himself with a pistol and
shot himself in the head. The self-inflicted gunshot wound did not incapacitate OSORIO and he
remained seated in the truck. Several minutes later, OSORIO exited the truck armed with a
semi-automatic pistol and was shot several times by officers on scene.
Orange County Fire Authority paramedics responded to the shooting incident scene and
treated OSORIO for multiple gunshot wounds, and transported him to Western Medical Center-
Santa Ana. Upon arrival at Western Medical Center-Santa Ana, OSORIO was treated by
emergency room medical staff and was subsequently pronounced deceased at 1324 hours.
