HomeMy WebLinkAboutCase 2024-26142 - 06242025_Redacted_Part4After making a purchase, they exited the furniture store and proceeded south on Broadway towards the parking structure. Before turning into the parking structure,   saw a subject standing at the corner. She described this  area as a gap between the furniture store and the parking structure.    She described the subject as a male wearing a “hoodie,” sweats or baggy pants and appeared homeless. She was  unable to see the suspect’s face because of how he was positioned. She approximated coming within 3 feet of the  suspect.      What also caught her attention, the subject was holding a long firearm, which was pointed in an upward position above his head. She described it as a long firearm, NFD. Although she did not see ammunition, it appeared the  suspect was loading the firearm because he was manipulating the firearm in that fashion.    She made eye contact with , who also observed the suspect, and immediately turned the opposite direction to walk away and walked back into the furniture store.   said she panicked fearing if they had walked in front of the  suspect, he would have shot them.   said there was no eye contact or communication with the suspect.     Once inside, they told employees of the suspect outside of the store. One of the employees took them to view  surveillance video cameras to point out the suspect, but the camera angles did not capture the suspect. Employees  proceeded to lock all doors leading into the store as a female employee called the police to report the incident. As the  employee was on the phone with the police,  heard 5-6 gunshots outside of the store. She remained inside of the  store until police arrived and evacuated them. said she did not witness the shooting and only heard the gunshots. said she feared for her safety and believed the suspect was going to shoot the stores and bars in the area. That  concluded our contact with    Investigation continues… F. Gomez #2706 Author: Gomez, Francisco 2706 BWC NOT Activated Narrative: Narrative Sunday, December 1, 2024 – 1745 hours: Santa Ana Police Department Detective Sergeant M. Lemmon #3174 notified detectives from the Homicide Unit of an officer involved shooting that occurred in the area of 200 N. Broadway in the City of Santa Ana, County of Orange and State of California. Sergeant Lemmon requested I respond to the crime scene to assist with the investigation. 1940 hours: I arrived at the southern perimeter of the crime scene. The crime scene was identified by crime scene tape on all sides. Uniformed patrol officers and police vehicles were present to secure the scene, preventing access by vehicular and pedestrian traffic. 2017 hours: I checked in on the crime scene log with Officer A. Carrillo #3424, the designated scene scribe, and entered the crime scene. 2018 hours: Sergeant L. Barragan #2937 conducted a briefing with detectives from the Homicide Unit, SAPD Professional Santa Ana PD 2024-26142 Report by Enriquez, David 3082 86 of 90 Standards Inspectors, and Investigators from the California Department of Justice regarding the initial response to the scene and the preliminary investigation by patrol personnel. 2041 hours: Sergeant Barragan concluded his briefing. At the conclusion of the briefing, Detective F. Gomez #2706 was assigned as the case agent. Detective Gomez assigned me to document the involved officer processing. 2125 hours: I exited the crime scene and signed out of the crime scene log with A. Carrillo #3424. I returned to the Santa Ana Police Department. 2314 hours: The officer processing was conducted in the Internal Affair’s office located on the 4th floor of the Santa Ana Police Department. This is a summary of the officer processing. The officer processing of Officer L. Casillas #3755 was completed prior to the processing of Officer Ibarra. For further details regarding the processing of Officer Casillas, please refer to Detective G. Raya’s supplemental report.   Department of Justice Special Agent Alvin Hernandez, Department of Justice Senior Criminalist Gina Williams, Santa Ana Police Department Internal Affair’s Corporal N. Guijarro #3482, Officer Isaac Ibarra #3178, Officer Ibarra’s representative Attorney Brett Rutkowski and I were present. Santa Ana Police Officer Ibarra is currently assigned as a patrol officer in the field operations division. I observed him wearing a Santa Ana Police uniform with police patches on each shoulder of the shirt. I observed a police badge on the upper left portion of his chest and a name tag displaying “Ibarra” on his right upper chest. Officer Ibarra was wearing a black nylon Sam Browne belt, which included a 9mm Glock 17 handgun (used during this incident). Officer Ibarra had his body worn camera (BWC) mount positioned in the center of his uniform. Officer Ibarra’s body worn camera had already been docked in the assigned housing dock for download. Senior Criminalist Williams examined and photographed Officer Ibarra, his uniform, Sam Browne belt including the items attached to his belt (firearm, Taser, magazine pouch, handcuff case) and the contents of his pockets. The handgun contained one (1) 9mm bullet in the chamber and seventeen (17) 9mm bullets in the magazine inserted in the handgun. Officer Ibarra had two additional magazines in his magazine pouch attached to his Sam Browne belt. The first magazine contained seventeen (17) 9mm bullets and the second contained six (6) 9mm bullets. All three magazines have a capacity of 17 bullets. 2348 hours: The officer processing of Officer Ibarra was concluded. WEATHER & LIGHTING Upon my arrival at the scene on 12/01/24 at 2017 hours, the weather was clear and dry. The temperature was 55°F,  as recorded on the weather app on my iPhone. Lighting was provided by streetlights and fixed lighting from surrounding businesses. SCENE The scene was located on Broadway, on the west sidewalk just south of 116 N Broadway (Casa Linda Furniture). Along the east side of Broadway, directly across from the scene, is Guadalajara Furniture, located at 117 N Broadway Broadway is a north-south asphalt-paved roadway with one lane of travel in each direction. A painted double yellow line extends approximately 100 feet north from 1st St before transitioning to a raised concrete median that continues to 2nd St. A raised concrete curb and concrete sidewalk exist on each side of the roadway. The Artists Village Apartments (300 W 2nd St) has a driveway entrance on the west side of Broadway leading to a covered parking lot. On the northwest corner of the building is a small alcove with an outward-opening metal door leading to an internal stairwell for 300 W 2nd St. The north wall of the alcove, shared with Casa Linda Furniture (116 N Broadway), displayed several apparent bullet strike marks, individually marked by forensic personnel with labels “A”  through “JJ.” There is metered street parking on the east side of Broadway. Three vehicles were parked in the metered stalls: 1.     White 2005 Chevrolet Van (CA license ), parked in front of 117 N Broadway. A food vending trailer, approximately 10 feet long and 6 feet wide with no identification, was parked behind the van but not connected. The van was unoccupied. 2.     Purple 2008 Mitsubishi 4-Door Sedan (CA license ), parked north of the white van. The vehicle was unoccupied. 3.     Green 2004 Chevrolet Tahoe Z71 (CA license ), parked on the east curb line of Broadway in front of 125 N Broadway. The vehicle was unoccupied. A marked Santa Ana Police vehicle (2020 Ford Explorer, CA license 1600677, vehicle unit #860) was stopped in the southbound lanes of Broadway, facing northwest, at the southeast corner of 116 N Broadway. The police vehicle’s driver-side window was rolled down, with a ballistic shield resting on the driver’s seat. The Unitrol was set to the second position, activating solid red and blue emergency lights. The vehicle’s overhead emergency light bar and forward-facing red lamp were functioning properly. I was asked to respond to the scene for a briefing by Sgt. L. Barragan. 2018 Hours – Sgt. Barragan provided preliminary information to detectives from the Homicide Unit, CA DOJ investigators, and forensic personnel. I was assigned to document the scene with CA DOJ Investigator J. Genens. 2019 Hours – I observed the crime scene secured with tape, SAPD vehicles, and uniformed personnel preventing entry. 2020 Hours – I walked the scene as CA DOJ Forensic personnel scanned and photographed the area. 2313 Hours – Photographs of SAPD unit #805, the 40mm less lethal device, and its interior and exterior were taken. Monday, December 2, 2024 0037 Hours – CA DOJ forensic personnel began evidence documentation and collection, including 3D scanning and measurements. 0306 Hours – The scene was released to SAPD Sgt. P. McClasky. Crime scene tape was removed, and the area was reopened to normal traffic. This concluded my involvement in the investigation.
