Dear Chief Rodriguez:
Pursuant to the January 3, 1990, Orange County Chiefs of Poiice and Sheriffs Association
Operational & Procedural Protocol, please find enclosed a flash drive containing the investigative
file refated to the officer-involved shooting of Marvin Ricardo Melgarejo. The drive contains
multiple reports and audio recordings generated and gathered by Orange County District Attorney
("OCDA") during the incident investigation.
The records are provided in confidence pursuant to Government Code section 7921.505,
subdivision (c) and OCDA maintains all applicable exemptions and privifeges including, but not
limited to, Evidence Code section 1040; Welfare and Institutions Code section 827; Penal Code
sections 832.7 and 13300 et seq.; and Government Code sections 7922.000 and 7923.600.
These records may only be used for purposes that are consistent with existing law and OCDA
must be notified prior to disclosure outside or your agency, including, but not limited to,
production in response to a California Public Records Act request.
By accepting these records and signing befow, you agree that your agency will maintain them in
confidence in accordance with the terms described above.
