Sarabia #2565 of the Santa Ana Police Department Homicide Section advising me an Officer Involved Shooting (OIS) had just occurred in the area of Rosewood Avenue and Bishop Street in the City of Santa Ana, County of Orange. Detective Sergeant Sarabia requested I respond to assist with the investigation. 2100 hours: I arrived to the station and waited for homicide detectives to arrive. Detective Sergeant Sarabia conducted a preliminary briefing of the incident with the homicide detectives. Detective Sergeant Sarabia informed us that at 1908 hours, Acting Watch Commander Sergeant O. Sanchez #2703 notified him of an Officer Involved Shooting. He stated the OIS occurred at approximately 1841 hours at Rosewood Avenue and Bishop Street and it involved Civic Center Patrol Officers C. Cofer #3626 and R. Santaella #3717. The officers conducted a traffic stop of a vehicle and the driver exited the vehicle armed with a handgun, at which time an OIS occurred. The driver ran to the area of 400 S. Shelton Street, where responding officers located him with apparent gunshot wounds. Detective Sergeant Sarabia told us there were no witnessing officers to the shooting. The passenger in the suspect vehicle and one civilian witness was transported to the police department to be interviewed by investigators. Patrol Sergeant M. Wharton #2888 was the scene supervisor. I was assigned as the case agent. 2115 hours: I arrived at the west perimeter located at Baker Street and Bishop Street. The scene was cordoned off with yellow crime scene tape. Patrol officers provided security for the crime scene. 2131 hours: Sergeant Wharton of the Santa Ana Police Department conducted the briefing. Present were personnel from the Santa Ana Police Department, Orange County District Attorney¶s Office and the Orange County Sheriff-Coroner Department Crime Laboratory. Sergeant Wharton provided the first half of the briefing. He stated the shooting occurred in front of 527 S. Rosewood Avenue. At 1841 hours, ³Alpha (a two officer unit) broadcasted they were involved in a shooting. The officers were identified as C. Cofer #3626 and Officer R. Santaella #3717. The officers broadcasted eight shots were fired in a northbound direction, the suspect was last seen running northbound on Rosewood Avenue and it was unknown if the suspect was struck. The passenger remained in the vehicle. The vehicle involved in the incident was a black 2003 GMC Yukon with CA License . The vehicle is registered to at . Officer Cofer and Officer Santaella reported hearing additional gunshots north of their location. Responding officers found Officer Cofer at the driver¶s side of his patrol vehicle and Officer Santaella on the passenger¶s side. Patrol Corporal B. Speakman #3360 obtained a public safety statement from Officer Cofer. Officer Cofer reported he fired 8 shots in a northbound direction from 1100 W. Bishop Street. One outstanding armed suspect fled the scene. Patrol Sergeant Wharton arrived on scene and helped secure the south perimeter. He also located a witness by the name of . was in her 2006 Silver Toyota Tacoma, with CA Lic: , at when the incident occurred. Patrol Sergeant P. Duran #3067 supervised the arrest of the passenger of the vehicle. The passenger was identified as Roberto Gonzalez-Diaz. Gonzalez-Diaz was on Post-Release Community Supervision for illegally possessing a firearm. Gonzalez-Dias was transported to the police department for an interview by investigators. Officers E. Mondragon #3659 and S. Caceres #3576 were standing by with Gonzalez-Diaz at the station. Eleven expended cartridges cases were located at the scene and possibly more cartridges cases were under the responding patrol vehicle. Also found at the scene was a handgun and a magazine. Santa Ana Police Department Forensic Specialist M. McKeever #3787 took photographs of the scene. Responding officers conducted a canvas of the neighborhood between 400-500 S. Rosewood Avenue and 1100 W. Santa Ana PD 2023-07962 5 of 8 Myrtle Street. Officers located several residences equipped with exterior home security surveillance cameras. Several resident were contacted and reported hearing gunshots. Sergeant Wharton concluded his portion of the briefing. Patrol Sergeant L. Barragan #2937 continued with the second half of the briefing. Sergeant L. Barragan informed us that he responded to 437 S. Shelton Street at approximately 1845 hours when MET Detectives T. Bell #3656 and J. McKee #3467 located the suspect on the east sidewalk of this location. The suspect was found with approximately four apparent gunshot wounds to the legs and left shoulder. The detectives rendered medical aid, including tourniquets to the suspect¶s extremities. Orange County Fire Authority (OCFA) Engine 75 personnel arrived on scene and transported the suspect to the Orange County Global Medical Center. At approximately 1922 hours, reported the suspect was in stable condition. A bullet core was located within the suspects clothing. Santa Ana Police Department Forensic Specialist S. Vasquez #3817 took photographs of the suspect at the hospital. The suspect was subsequently identified as Marvin Ricardo Melgarejo a documented ³Bishop Street´gang member with the moniker of ³Saint.´Melgarejo had prior arrests for illegal firearms possession. Officer D. Bland #3753 and Officer D. Taroy #3756 were with Melgarejo in room #420. A female subsequently identified as arrived on scene and identified Melgarejo as her son. Sergeant Barragan asked Officer Cofer and Officer Santaella for a public statement. Officer Cofer provided the same statement he provided Corporal Speakman. Officer Santaella reported he fired six times in a northbound direction from Rosewood Avenue and Bishop Street. There was one-armed outstanding suspect, who was the driver of the vehicle. The items at the scene where Melgarejo was located consisted of a cell phone and clothing cut from Melgarejo¶s person by paramedics. A male identified as residing at reported hearing five gunshots and then observing the suspect discard and item into the backyard of a neighboring residence. Officer M. Marignoil #3858 searched the backyard of 1048 W. Myrtle Street and recovered a black baseball hat with a white ³B´logo. Sergeant Barragan concluded his briefing. After the briefing, I was paired with Orange County District Attorney Investigator C. Gonzalez. We were tasked with conducting interviews of Gonzalez-Diaz and Melgarejo. 2216 hours: I checked in with Officer G. Cardona #3860 who was the scribe at the scene. DA Investigator C. Gonzalez and I walked the scene. 2218 hours: We checked out with Officer G. Cardona and returned to the Santa Ana Police Station with Detective F. Gomez. Saturday, April 8, 2023, 0028 hours: DA Investigator C. Gonzalez from the Orange County District Attorney¶s Office Special Assignment Unit and I interviewed Roberto Gonzalez-Diaz at the Santa Ana Police Department on the third floor of the Investigation Bureau in room 3141-4. Gonzalez-Diaz was the passenger in a black 2003 GMC Yukon with California License Plate # , which was involved in an Officer Involved Shooting. The interview with Gonzalez-Diaz was audio recorded by DA Investigator C. Gonzalez. The following is a synopsis of the interview with Gonzalez-Diaz. Prior to us speaking with Gonzalez-Diaz, I read him his Miranda Rights using the Santa Ana Police Department Statement form Advisement of Rights in English, which he understood. We asked Gonzalez-Diaz where he was earlier today around six o¶clock and who was he with? Gonzalez-Diaz told us he was with a friend, but he did not know his name. He stated he picked his friend up at his residence so they could go to a dance in LA and he had him drive because he was going to be drinking and did not want to drink and Santa Ana PD 2023-07962 6 of 8 drive. Gonzalez-Diaz said they were stopped and "he just takes off". Gonzalez-Diaz said, "he runs off from the car". We asked Gonzalez-Diaz why he ran from the car and he said, ³I have no idea.´Gonzalez-Diaz said he asked him when they turned, but he did not answer. Gonzalez-Diaz stated it happened fast. We asked Gonzalez-Diaz where he pick his friend up and he stated from his house located on Bishop Street. Gonzalez-Diaz stated he did not know the address. I told Gonzalez-Diaz that I know he knows who his friend is and he replied, ³He's a friend.´I know you know what his name is. At this time, I told Gonzalez-Diaz that I did not want him to start with lies because we know that he knows who his friend is. I explained to Gonzalez-Diaz that I did not want him to waste our time or waste his time and I wanted him to be honest. Once again, I asked Gonzalez-Diaz what his friends name was and he stated ³Marvin Vallejo.´He told us he picked him up on Bishop Street at an unknown address. We asked Gonzalez-Diaz where his friend is from and he replied, ³I don¶t know where he is from.´ We asked him if he was from Bishop Street and he stated, ³I don¶t know.´We asked Gonzalez-Diaz where was he from and he stated he was not from a gang. We asked Gonzalez-Diaz if he was on probation or parole and he stated ³High probation and parole.´We asked if he is supposed to be with people that he should not be with and he replied, ³No.´ Gonzalez-Diaz told us he has known Marvin for a year and he does not know why he ran from the vehicle. We asked him if Marvin had a gun and he stated, ³I don¶t know he did not tell me he did.´We asked him what occurred after Marvin ran and he stated nothing happened. He stated he had his hands outside the window. He said he was handcuffed and brought to the police station. We asked him if Marvin is known to carry weapons and he said, ³No.´We told Gonzalez-Diaz if it would surprise him if we told him Marvin had a gun and he replied, ³Yeah.´Gonzalez-Diaz said Marvin would have told him if he had a gun, but he did not tell him. At this time, I showed him a DMV photo with all the pertinent information covered and he identified the person in the photo as his friend by the name of Marvin. Gonzalez-Diaz stated this was the same person he was with, the same person that was driving his vehicle and the same person that ran from the vehicle. He stated the party they were attending was in the City of Los Angeles on Pico Avenue. He stated he sent the flyer to Marvin and asked him if he wanted to go. We asked Gonzalez-Diaz what time he picked up Marvin from his house and he stated ³Around six.´He said when they were pulled over they were already on their way to LA. At this time, we showed him a map in an effort to show us were they were stopped. Gonzalez-Diaz told us he believed it was Shelton were they were stopped. We asked Gonzalez-Diaz if he was sure and he stated he was not 100% sure. Gonzalez-Diaz stated it was either Shelton or the next street over, which was Rosewood. We asked Gonzalez-Diaz if he knew what happened to his friend and he replied, ³No, when I saw them shooting at him, I saw him run away. Gonzalez-Diaz said Marvin was wearing a black sweater and that is all he remembers. At this time, DA Investigator C. Gonzalez told Gonzalez- Diaz that he was there to investigate why the officers fired their weapons. We asked Gonzalez-Diaz what direction they were traveling? Gonzalez-Diaz stated they were between Flower Street and Shelton Street and believed they turned on Shelton Street, but he was not sure. We asked Gonzalez-Diaz if he knew the police was behind them. Gonzalez-Diaz stated when they saw the police they were driving on Bishop Street (Westbound) towards Bristol Street. He said the police vehicle drove passed them, made a U-turn on Shelton, got behind them and that is when they turned (Rosewood). Gonzalez-Diaz said the police vehicle did not have the lights on, but Marvin made a right turned and stopped. Gonzalez-Diaz asked Marvin what was he doing and why didn¶t he go straight, but Marvin did not answer. Gonzalez-Diaz said Marvin opened the door and began running. He told us he did not know the police had pulled behind them. Gonzalez-Diaz told us as soon as Marvin stepped out to run he heard the police shooting at him. We told Gonzalez-Diaz that there was some time that passed when they stopped before Marvin decided to run and he stated, ³It was about a minute.´We asked him if he knew the police were already behind them and he replied, ³I think so.´We asked him if he heard the police giving commands at them and he stated ³I don¶t remember.´We asked if he looked back through his side rear view mirror to see if they were behind him and he replied, ³Yeah, I knew they were behind us.´He stated he did not see any lights on the car, but he knew it was a police car.+H VDLG LW KDSSHQHG IDVW 0DUYLQ RSHQHG WKH GRRU DQG UDQHe said as soon as Marvin ran, they started shooting. He stated he did not know why they started shooting at him. We asked if he saw Marvin holding a gun and he said, ³No.´He said Marvin did not mention he had a gun, because if he would have he would not have allowed him in his car. We asked Gonzalez-Diaz if he saw Marvin throw anything and he said, ³No.´We asked Gonzalez-Diaz if Marvin told him he was going to pull over, and run, and he replied, ³No.´Gonzalez-Diaz told us he asked Marvin what are you doing, but he did not answer. He said Marvin did not tell him he was going to run. He just opened the door and ran. At this time, we concluded the interview with Gonzalez-Diaz. Santa Ana PD 2023-07962 7 of 8 Tuesday, April 11, 2023, 0855 hours: On the above date and time, DA Investigator C. Gonzalez and I went to Orange County Global Medical Center located at 1001 N. Tustin Ave in the City of Santa Ana, County of Orange to interview Marvin Ricardo Melgarejo. The interview was conducted in English and audio recorded by DA Investigator C. Gonzalez. Marvin Ricardo Melgarejo was on the fourth floor in room #420. Prior to speaking with Melgarejo, I read his Miranda Rights using the Santa Ana Police Department Statement form Advisement of Rights. Melgarejo understood his rights and stated he did not want to speak with us without his attorney. At this time, we concluded the interview with Melgarejo. 1330 hours: I received a telephone call from DA Investigator C. Gonzalez who told me the Officer¶s gun where ready to be picked up from the Orange County Crime Lab. 1340 hours: Detective Corporal R. Bonilla #2307 and I met with DA Investigator C. Gonzalez at the OC Crime Lab located at 320 N. Flower Street to retrieve Officer¶s Cofer and Santaella. 1350 hours: Detective Corporal R. Bonilla and I returned to the Santa Ana Police Department and met with Internal Affairs Sergeant J. Lopez in their office located on the fourth floor and relinquished Officers Cofer and Santaella weapons.
