The police vehicle stopped parallel to her vehicle, facing north towards Myrtle Street. observed two
Police Officers exit the police vehicle, one from the driver side and one from the passenger side. Both
Officers had their guns drawn and pointed out towards the black vehicle. said the police vehicle was
clearly marked and identifiable as a police vehicle. She also identified the two Officers as Police Officers
because she saw their marked police uniforms. said she then heard 2-4 gunshots and believed the
Police Officers fired their weapons. did not see the actual shooting and only heard the gunshots.
was asked if she heard the Officers giving to the occupants of the black vehicle commands.
said her windows were up and could not remember if anything was said or yelled to the occupants. At some
point after hearing the gunshots, the Officer that exited the passenger side of the police vehicle took out a
rifle from the police vehicle.
We asked if she saw any of the occupants of the black vehicle exit or flee from the vehicle. said the
brown SUV that was parked in front of her vehicle was blocking her view. She was only able to see a
³gangster´exit the black vehicle from the driver side and taken into police custody.
said she called her sister, Margarita Hernandez, and told her what was going on as the incident
unfolded. She told us that she recorded the incident with her cell phone. She showed us four video clips.
VIDEO CLIP # 70261141391__4F1CD644-5386-4EC2-9A42-2E74F9BD5D48:
is heard in the background, in Spanish, telling someone to call ³your dad´because a shooting took
place in front of the house and she could not get out of the truck. I observed two police vehicles with several
Police Officers walking into camera view. It appeared was seated in the driver seat of her vehicle as
the steering wheel was visible.
VIDEO CLIP # 70261141391__4F1CD644-5386-4EC2-9A42-2E74F9BD5D48:
told that she was in her truck and that a shooting took place. The police were on scene and
she could not get out of her truck.
VIDEO CLIP # 70261120236__22001F5C-B4DE-4DBD-BA18-840802F8AD0B:
told ³ ´that she was in her truck, a subject was armed with a gun and a shooting took place
outside.
VIDEO CLIP # 70261130496__06F91235-A718-47C3-BC0B-D6571C7D2D1B:
told ³ ´she was in front of her residence, a shooting took place and that she heard it.
None of the clips captured the shooting. allowed me to download the clips, which were uploaded to
evidence.com.
I obtained a GOOGLE map of the area and showed it to placed a circle at the northeast
corner of Rosewood Avenue and Bishop Street to mark her location at the time she heard the shooting. She
told us she was parked on right in front of her residence, .
She drew an arrow to indicate the direction of travel of the suspect vehicle, east on Bishop Street and north
on Rosewood Avenue. For details, refer to the map that was booked into evidence.
Investigator Gonzales showed a hand drawn diagram of the area. He kept the diagram.
It should be noted, said she suffers from seizures and Parkinson¶s disease. That concluded the
interview.
This concluded my role in the investigation on this date.
