It is important to note that the suspect had not been searched at this point. Based on my training and experience, I am
aware that individuals often conceal firearms in their waistbands.
Given the totality of the circumstances, including the use of a firearm in the robbery and the suspect actively resisting,
I delivered one knee strike to the right side of the suspect’s head and checked for compliance. The strike was
ineffective, as the suspect continued reaching for his waistband. I heard officers giving clear and direct commands for
the suspect to give them his hand, which he continued to ignore.
To overcome the suspect’s resistance and effect the arrest, I delivered two additional knee strikes to the right side of
his head and again checked for compliance. The final knee strike had the desired effect, enabling Officers Monaco
and Nevarez to gain control and handcuff the suspect. I placed my left knee on the suspects head, in order to assist
officers in handcuffing the suspect while also maintaining a position of tactical advantage, due to the possibility of a
second suspect also fleeing into the yard.
I readjusted and maintained my left knee on his head, while the majority of my body weight rested on my right knee.
To prevent the suspect from getting up or resisting further, I briefly placed and maintained my left knee on his head,
applying minimal pressure. I then got up and took a defensive position in order to provide security for officers.
Given the circumstances, we requested the Orange County Fire Authority (OCFA) to respond and provide medical
evaluation for the suspect, later identified as (positively identified in the ICR See Officer Perez’s ICR for
further details).
This concluded my involvement in the investigation.
