LEON was wearing a black t-shirt with white letters and was holding a small child. LEON walked away from the vehicle towards the rear of 506 East Washington Avenue. As he did, the female followed him and yelled “Junior, give me the baby!” GARCIA described her view as including the first four steps of a staircase that lead to an upper apartment attached to the rear of 506 East Washington Avenue. LEON carried the baby to the rear of the house and up the stairs. Shortly afterwards, heard two loud “bang, bang” sounds that she believe were gunshots. She looked towards the area she had last seen LEON and saw him coming from the area of the staircase. He quickly walked northbound on the driveway towards the black car he had earlier exited. GARCIA noticed LEON was carrying something in his right hand and did not have the baby with him. GARCIA described the item as black and larger than a cellular telephone. As he neared his vehicle at the end of the driveway, LEON suddenly stopped walking, used his left hand to lift up the front of his black t-shirt, then put the item he had in his right hand into his waistband. LEON ran southbound on the driveway and into the backyard behind 506 East Washington. described LEON’s movements as though he was surprised or startled when he got near his vehicle at the end of the driveway. Based on the manner in which he placed the item in his waistband, believed that LEON was armed with a handgun. As LEON ran to the back of the house, noticed two police officers run after him. She described the officers’ movements as slower than LEON and very cautious. Although LEON was running fast, the officers ran slower and stopped when they got to the back edge of the S.A. 12-031 Investigator: Brett Andersen Approved By: Date of Report: 12/21/12 Date:01/02/13 Page 3 of 3 house, near the garage, before they slowly entered the backyard area and lost sight of them.
