CLASSIFICATION: OFFICER INVOLVED SHOOTING (NON-FATAL) AGENCY: SANTA ANA POLICE DEPARTMENT DATE AND TIME: DECEMBER 16, 2012 2344 HOURS LOCATION: 506 EAST WASHINGTON AVENUE SANTA ANA, CA AGENCY CASE NUMBERS: SAPD: 12-36993 OC CRIME LAB: 12-58683 On Sunday, December 16, 2012, at approximately 0100 hours, I spoke with Santa Ana Police Commander COLEMAN who advised of an officer involved shooting, which occurred at 506 East Washington Avenue, in the city of Santa Ana. COLEMAN requested the Orange County District Attorney’s Officer Involved Incident Investigation Team, respond to the location and conduct an investigation into the incident. I notified District Attorney Investigators BRETT ANDERSEN, TOM CONKLIN, KORY DEGRAFFENREID, PAUL CARVO, MARK GUTIERREZ, FRANK REYNOSO and ED WOOD and requested they respond to assist in the investigation. I went to the shooting location and met with personnel assigned to the incident. On December 16, 2012 at approximately 0245 hours, Santa Ana Police Sergeant JAY MILLER conducted a briefing on the known circumstances surrounding the incident for personnel involved in the investigation. I learned the following from the briefing and preliminary investigation: ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION PREFACE S.A. 12-031 Supervising Investigator: R. Seman Date of Report: 01/29/2013 Page 2 of 3 On December 16, 2012, at 2344 hours, Santa Ana Police Officers DAVID GARCIA and DANNY ALCALA were dispatched to 506 East Washington Avenue in regard to a male and a female arguing. Officer ALCALA arrived at 2344 hours and Officer GARCIA arrived at 2345 hours. The following description of the event is based on witness statements: IGNACIO LEON JR. arrived at the location in a black Ford Expedition and walked up stairs to his mother’s apartment. LEON’s girlfriend, questioned LEON about where he had been and why he was drunk. They began to argue and LEON’s mother told him to leave the residence. LEON, and their baby went downstairs and continued to argue in the driveway. took the baby from LEON and they both returned upstairs to the apartment. A neighbor heard two loud bangs and observed LEON running down the stairs. The neighbor witnessed LEON walk back towards the Ford Expedition with a black object in his right hand. When he arrived at the Ford Expedition, he lifted his shirt and put the black object into his waistband. Leon ran into the backyard followed by the two officers. Shortly after, the neighbor heard two to three gunshots. Officer GARCIA fired 3 rounds at LEON, striking him twice. One round struck LEON in the upper right chest and a second round in the lower right abdomen area. LEON was treated at the scene for his injuries and was transported to Western Medical Center – Santa Ana. At Western Medical Center, LEON went into surgery where his and .
