CLASSIFICATION: OFFICER INVOLVED SHOOTING (NON-FATAL) INTERVIEW OF: SANTA ANA, CA 92701 CELL: 714 PRESENT: ANDY ALVAREZ, DETECTIVE SANTA ANA POLICE DEPARTMENT MOISES JIMENEZ, OFFICER SANTA ANA POLICE DEPARTMENT DATE AND TIME: DECEMBER 16, 2012 0400-0440 HOURS LOCATION: 506 EAST WASHINGTON AVENUE #C, SANTA ANA On the above listed date and time, I conducted an audio digitally recorded interview of regarding an officer involved shooting involving IGNACIO LEON JR. and the Santa Ana Police Department (SAPD). SAPD Detective ANDY ALVAREZ and Officer MOISES JIMENEZ were also present during the interview. The interview was conducted primarily in Spanish. It should be noted that LEON’s nickname is “CHEETOS”, and often referred to him as “CHEETOS” during the interview. The following is a summary of the interview: rents a room at Santa Ana. On December 15, 2012, at approximately 2200 hours, came home and found s son, IGNACIO LEON JR, his girlfriend, , and their two year old son, , were at the apartment. They had come over to visit . Approximately 40 minutes later, LEON, left to go home. Approximately five minutes after leaving, they returned to the apartment, and LEON and were arguing. LEON wanted to continue fighting and arguing with while , and tried to calm him down. Eventually, were able to force LEON out of the apartment. said LEON was very persistent in trying to come back into the apartment to continue fighting with . had to use some force to keep LEON from going back into the apartment, but they were able to get him down the stairs and away from the front door. After getting LEON downstairs, went into the backyard to smoke a cigarette. He saw LEON walk toward the street, but he did not see where went. A few minutes later, he heard LEON banging on the front door and window of the apartment. saw that LEON had gone back up the stairs and was banging on the door, trying to get into the apartment. saw LEON bang on the window next to the front door, and then the window broke. After the window broke, LEON quickly walked back down the stairs and went toward the street. SA 12-031 Investigator: P. At this time, was standing at the southwest corner of the backyard, smoking a cigarette. As LEON ran through the backyard, he said something about the police being there. LEON spoke in English, so was not able to understand exactly what LEON said. watched LEON run through the backyard and jump over the south wall of the yard. He said LEON jumped over the wall between the tree and the rod iron fencing that was against the south wall. As LEON jumped over the wall, started walking back to the stairs leading to his apartment. He then saw two police officers run into the backyard. The officers were holding flashlights and appeared to be looking for LEON. He did not see either officer holding a gun. He heard the officers saying something in English, but he did not understand them. When the officers realized that LEON had jumped over the south wall, one officer remained in the backyard while the other officer ran back toward the street. started walking up the stairs to his apartment. He saw the officer who remained in the backyard walk toward the southwest corner of the backyard, near a white table. He then heard one of the officers yell, “Stop!” was not sure if the officer who yelled “Stop” was the one in the backyard or if it was a different officer on the other side of the fence. A few seconds later, heard 2-3 gunshots come from the southwest corner of the backyard. He did not see who fired the shots and did not see any police officers with their gun out. After the gunshots, heard LEON yelling from the other side of the fence that he was in pain. SA 12-031 Investigator: P. He has never seen LEON cause any problems before and has no knowledge of LEON having prior police contacts. He has never seen LEON in possession of a gun.
