TYPE: INITIAL RESPONSE - CANVASS
AGENCY: SANTA ANA POLICE DEPARTMENT
On December 16, 2012, at approximately 0115 hours, Orange County District Attorney
Supervising Investigator RON SEMAN contacted me regarding an officer involved shooting
involving the Santa Ana Police Department. SEMAN requested I respond to the area of 506 East
Washington Avenue, Santa Ana, to assist with the investigation.
I arrived on scene at approximately 0200 hours and met with investigators from
the Orange County District Attorney’s Office (OCDA) and the Santa Ana Police Department
(SAPD), who were present to assist with the investigation.
At approximately 0245 hours, SAPD Sergeant JAY MILLER conducted a briefing regarding
the known circumstances of the incident for the personnel involved in the investigation.
Following the briefing, OCDA Supervising Investigator RON SEMAN directed me to team with
SAPD Detective ANDY ALVAREZ to conduct a canvass for potential witnesses. I conducted the
following audio digital recorded canvass interviews:
On December 16, 2012, at approximately 2350 hours, was sitting on the
couch in his living room, watching TV, when he heard a man and woman arguing.

thought the man and woman were arguing either on the driveway outside his apartment or on
the stairs that lead to the upstairs apartment (#C) of his building. said he mostly
heard the male voice yelling and the female was crying. then heard the sound of
police officers walking past his apartment. He believed they were police officers because of the
sound of their gun belts and equipment. He then heard a police officer say, “Where did he go?”
A few seconds later, heard the same police officer yell, “Show me your hands!” He
then heard the sound of running and a police officer yell, “Stop right there!” heard a
male voice respond by yelling something to the effect of, “Fuck you!” then heard
three gunshots. got down on the floor of his apartment and did not look outside to
see what was going on.
said she was sleeping on the couch in her living room when her boyfriend,
, woke her up. heard police officers walking past her apartment.
She heard one officer say, “Where did he go?” She then heard something that sounded like a
person laughing. She recognized the voice of the person to be a man she knows as “Cheetos”,
who is the son of her upstairs neighbor. A few seconds later, she heard two gunshots.
got down on the floor of her apartment and did not look outside to see what was
going on.
was asleep in bed when his sister, , came in and told
him to get on the floor because she had heard gunshots. did not see or hear anything.

not want to wake her up. other daughter, , is less than two
months old.
was watching TV in the living room when he heard a loud noise come
from the upstairs apartment. checked on his wife and daughters in their
bedroom. He then opened his front door and looked outside. He saw a police car parked
outside, so he closed the door and continued watching TV. A few minutes later, two police
officers knocked on his front door. When he answered the door, the officers asked him if he
had been fighting with his wife. He told them he had not, but they asked to speak to her.
While he was getting his wife from the bedroom, heard one officer say
something in English to the other officer. did not fully understand what the
officer said, but he thought it was something about someone running toward the rear of the
building. The two officers then ran toward the backyard of building. Less than
a minute later, he heard two or three gunshots come from the area of the backyard.
did not look outside to see what had happened.
was in the living room of his home when he looked out the window and noticed
two police cars parked across the street. He saw two uniformed police officers walk toward
506 East Washington Avenue. did not see where the officers went, and he did not see
anyone else in the area. A few minutes later, friend, , told
him he heard gunshots. was also in the living room with did not
hear the gunshots himself.

was in the living room of his home at approximately midnight when he
heard three gunshots come from across the street. He did not look outside to see what had
happened.
was asleep in his bedroom at the time of this incident. He did not see or hear
anything and did not know about the shooting until he left for work in the morning.
was asleep in her bedroom at approximately midnight when she heard 2-3
gunshots come from the area of the street in front of her house. After a short time, she got up
and looked out the window and saw several police cars across the street -from her house.
