CLASSIFICATION: OFFICER INVOLVED SHOOTING (NON-FATAL) TYPE: OFFICER PROCESSING / CANVASS AGENCY: SANTA ANA POLICE DEPARTMENT On Sunday, December 16, 2012, at approximately 0105 hours, I was contacted by Orange County District Attorney Supervising Investigator RON SEMAN regarding an officer involved shooting, involving officers from the Santa Ana Police Department. The incident occurred in the 500 block of East Washington Avenue, in the city of Santa Ana. SEMAN requested I respond to the incident scene and assist with the investigation. I arrived at approximately 0200 hours. At approximately 0245 hours, Santa Ana Police Sergeant JAY MILLER conducted a briefing surrounding the known circumstances of the incident for the personnel involved in the investigation. At approximately 0300 hours, SEMAN directed me to team with Santa Ana Police Detective DOMINGO CABRERA and respond to the Santa Ana Police Department to witness Orange County Sheriff’s Department Forensic personnel, while they processed the officers involved in the shooting incident. At approximately 0408 hours, Orange County Sheriff’s Department Forensic Specialist HILARY PEPLOWSKI photographed the officer involved in the shooting incident and collected the following under FR# 12-58683: Santa Ana Police Officer DAVID GARCIA #3231 • Glock, Model 22, .40 caliber semi-automatic pistol, Serial Number: LGU499 • One magazine from the pistol containing 12 rounds and 1 round from the chamber of the pistol • Two additional magazines from magazine pouch each containing 15 rounds ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT S.A. 12-031 Investigator: MARK GUTIERREZ Approved By: Date of Report: 12/17/2012 Date:12/18/12 Page 2 of 4 GARCIA also carried a Taser X-26, Serial Number: X00-546327, with one Taser cartridge (Photographed) At approximately 0427 hours, PEPLOWSKI photographed and conducted a round count on the following officer: Santa Ana Police Officer DANIEL ALCALA #3226 • Glock, Model 22, .40 caliber semi-automatic pistol, Serial Number: LGU505 • One magazine from the pistol containing 15 rounds and 1 round from the chamber of the pistol • Two additional magazines from the magazine pouch each containing 15 rounds • Taser X-26, Serial Number: X00-658005, with one Taser cartridge At approximately 0510 hours, I responded back to the incident scene and assisted in the neighborhood canvass, and contacted the following residents: 1218 North Lacy Street Vacant residence On December 15, 2012, at approximately 2130 hours, went to bed for the evening. At approximately 0000 hours, awoke to noise outside his residence. looked east out his residence window and observed uniformed police officers across the street. He did not see or hear any part of the shooting incident. On December 15, 2012, at approximately 2330 hours, went to bed for the evening. At approximately 0000 hours, heard two to three gunshots fired in rapid succession. then heard an unknown male yell, “Stop!” approximately three times in English, after the gunshots. walked outside his residence and observed an unknown male lying in the parking lot, across S.A. 12-031 Investigator: MARK GUTIERREZ Approved By: Date of Report: 12/17/2012 Date:12/18/12 Page 3 of 4 the street. Three or four uniformed police officers were present as the subject was handcuffed and searched. Fire Department Paramedics responded and rendered medical aid to the subject. On December 15, 2012, at approximately 2100 hours, went to bed for the evening. He awoke at midnight and heard a helicopter and police activity outside. did not see or hear anything related to the shooting incident. On December 15, 2012, at approximately 2200 hours, went to bed for the evening. At approximately 0000 hours, was awoken to three apparent gunshots fired in succession. did not witness the shooting incident On December 16, 2012, at approximately 0000 hours, was inside her apartment when she heard three gunshots fired in succession. then heard someone yell, “Don’t move.” then heard someone, “groaning” as if they were in pain. Police officers responded to the location, within minutes. did not witness the shooting incident. 1114 North Lacy Street Vacant Residence On December 15, 2012, at approximately 2230 hours, heard screaming and yelling followed by two apparent gunshots. looked east outside his residence window and observed two uniformed police officers standing in the parking lot, on the east side of Lacy Street. The officers told the subject, “Don’t Move!” was asleep at the time of the shooting incident and did not see or hear anything related to the shooting incident. On December 15, 2012, at approximately 2300 hours, heard sirens and then he observed police activity outside. He did not see or hear any part of the shooting incident.
