CLASSIFICATION: OFFICER INVOLVED SHOOTING (NON-FATAL) INTERVIEW OF: SANTA ANA, CALIFORNIA 92701 PRESENT: DETECTIVE LEO RODRIGUEZ SANTA ANA POLICE DEPARTMENT DATE AND TIME: DECEMBER 20, 2012 0600-0636 HOURS LOCATION: 506 EAST WASHINGTON AVENUE, SANTA ANA On December 20, 2012, at approximately 0600 hours, I conducted an audio digitally recorded interview with regarding the above case. Present during the interview was detective LEO RODRIGUEZ of the Santa Ana Police Department. rented the couch in the living room at Santa Ana. He said that on the night of the shooting incident, LEON was causing a problem inside the apartment and was asked to leave. When he wouldn’t leave the apartment, escorted LEON out of the apartment and LEON’s mother locked the door behind them. Out of frustration, LEON broke the window next to the front door. told LEON to leave before someone called the cops. and LEON went downstairs and LEON went northbound on the driveway as if to leave. started back up the stairs when LEON ran back into the yard and yelled “fucken cops…”! LEON continued running and jumped over the block wall at the south side of the yard. They pointed their guns and lights at who was wearing a light gray sweatshirt, but one officer said to the other “that’s not him, he’s (LEON) wearing a t-shirt”. The officers briefly focused on who was standing in the southwest corner of the backyard and was wearing a red “hoodie” sweatshirt, but they disregarded him too. did not know name, but said that he lives in the same apartment as did not know why, but one officer left the backyard, while the other officer stayed and continued looking for LEON. walked up the stairs to their apartment. When they were approximately ¾ of the way up the stairs, looked back towards the backyard and heard the officer tell LEON “get out with your hands up” saw that LEON was in the alcove next door. During the interview, pointed to an alcove area that was located at the south end of the garage structure for 1221 through 1227 North Lacy Street. Between the south end of the garage and a cinder block wall that bordered the parking lot of French Park Care Center, there was a space approximately four to five feet wide that ran the width of the garage. At the east end of the alcove was an approximately five to six foot wooden fence that separated the properties of 1221 through 1227 North Lacy Street and 506 East Washington Avenue. The block wall was approximately six feet tall and three inches wide. said the officer in the backyard was standing under a large tree next to the south wall. The officer’s left foot was on a makeshift bench that was nailed to the base of the tree and his right foot was on the ground. According to , somehow LEON was able to get out of the alcove and on to the top of the block wall. saw LEON with his hands raised in the air above his head, walking on top of the 3 inch wide wall. As LEON stood on the wall above the officer with his hands in the air, LEON yelled at the officer in a slurred voice “fuck you motherfuckers”! The officer shot LEON three times. said that LEON drank one large bottle of beer and left another one inside the apartment. had not consumed any alcohol that evening.
