AGENCY: SANTA ANA POLICE DEPARTMENT
On Monday, September 10, 2012, at approximately 0115 hours, Orange County District
Attorney Supervising Investigator RON SEMAN contacted me regarding an officer involved
shooting incident involving the Santa Ana Police Department. SEMAN requested I respond to
3005 South Bristol Street, in the city of Santa Ana, and assist with the investigation.
At approximately 0215 hours, I arrived at the incident location and met with
investigators from the Orange County District Attorneys Office (OCDA) and from the Santa Ana
Police Department (SAPD) who were present to assist in the investigation.
At approximately 0255 hours, Santa Ana Police Sergeant MATT SORENSON conducted a
briefing of the known circumstances surrounding the incident for the personnel involved in the
investigation.
After the briefing, OCDA Supervising Investigator RON SEMAN requested that I conduct a
canvass for potential witnesses in the area and directed me to team with SAPD Homicide
Detective JIM GARCIA. We conducted the following audio digital recorded canvass interviews:
SANTA ANA, CA
was asleep in bed at approximately 0030 hours, when he heard (4)
gunshots in rapid succession. He did not witness the shooting and did not hear any yelling prior

to or after the gunshots. He couldnt remember whether he looked out the window after the
incident.
SANTA ANA, CA
was asleep in bed when he heard (4) loud bangs in rapid succession.
He thought someone was banging on their window. He got up, looked out the south facing
window and didnt see anything. He did not witness the shooting and did not hear any yelling
prior to or after the gunshots.

was in room # changing his clothes when her heard (5) gunshots in rapid
succession, then (2) more gunshots in rapid succession a few seconds later. Approximately a few
seconds after the gunshots, looked out his south facing window and saw 3‐4 police cars
and 3‐4 police officers in the east alley of 3005 South Bristol Street pointing their handguns

westbound toward the shopping center. also observed a subject lying on the
pavement. grabbed his video camera and started to videotape the scene through his
open south facing window, looking through the screen.
observed a subject lying on the pavement behind the shopping center with
officers around him, possibly holding him down. observed the subjects feet moving
around as he was lying on the ground. Later, observed a subject being pushed from the
scene in a wheelchair. said as he was looking out his window videotaping he noticed an
unknown female resident standing west of his window possibly videotaping as well.
could not provide us with any further information reference the female.
willingly provided me with the digital SD card from his video camera so that I
could take it back to the OCDAs office and make copies of the videos. On September 10, 2012, I
made copies of the (4) video files that had taken of the incident.
Video #1 lasts approximately 7 ½ minutes, and starts after the shooting with several
police vehicles already at the scene and several more arriving. The video is initially filmed
looking through closed south facing window and screen. Approximately 3 minutes
into the video, focuses his camera on several police officers rendering aid (including
chest compressions), to a subject on the pavement. The subjects feet are moving back and
forth at the time. Approximately 4 minutes into the video a subject wearing a white long sleeve
shirt is wheeled past the scene in a wheelchair being pushed by one of the police officers.
At approximately 5 minutes into the video opens the window and screen and
continues videotaping. In the latter parts of the video you can hear a females voice in the
background talking to someone else possibly on the phone. The female mentions having

possibly videotaped after the incident. At approximately 7 minutes into the video the
paramedics arrive on scene.
Video #2 lasts approximately 19 seconds, and starts after the shooting with several police
vehicles already at the scene.
Video #3 lasts approximately 5 seconds, and is blank.
Video #4 lasts approximately 1 second, and starts after the shooting with several police
vehicles already at the scene.
SANTA ANA, CA
On Sunday, September 09, 2012, between approximately 1100 and 1200 hours,
was with his parents and in their vehicle getting
ready to leave their apartment/motel parking lot. At that time they observed a male subject
sitting in the drivers seat of a Jeep in the same parking lot. The subject was in his mid thirties
and was wearing a black baseball cap. The subject drove out of the parking lot in the Jeep.
told he thought the subject was the same one that had
attempted to break into their apartment recently. believes his father may have
written down or memorized the Jeeps license plate. said he felt he could possibly
identify the subject, if he saw him again.
Between approximately 2300 and 2400 hours was inside their apartment with
his parents and his grandmother . During that time, his father
observed the same Jeep parked across the street in the alley behind the shopping center at 3005
South Bristol Street. called the police to report the suspicious vehicle. After calling the

police department, parents looked out their south facing window waiting for the
arrival of the police.
As his parents were looking out the window, heard (4) gunshots in rapid
succession, and a few seconds later looked out the south facing window. observed the
same Jeep he had seen earlier in the day parked in the alley facing north, and a police car (later
identified as Unit # 856), facing south with a police officer standing on the drivers side of the
police car.
The police officer was pointing his handgun toward a male subject walking near the front
grill of the Jeep. The subject walked toward unit # 856 then fell to the pavement. could
not remember the exact positioning of the subjects hands and did not observe the subject
carrying anything. The subject was wearing a short sleeve gray shirt and blue pants.
could not remember whether the subject was wearing a hat. also observed a male
subject in a wheelchair near the drivers door of the Jeep. said the subject in the
wheelchair is homeless and sells meth‐(methamphetamine).
During the interview, allowed us to enter their apartment to observe the view he
and his parents had from their south facing window. By looking south through the window, we
observed a Jeep facing north in the alley, a police vehicle facing north behind the Jeep, and unit
# 856 facing south.
said after the shooting his parents started videotaping the police activity by
positioning a webcam facing out the window. The webcam was connected to his mothers
laptop computer. parents were at the Santa Ana Police Department being
interviewed during our contact with . After our interview with , I was informed
by OCDA Investigator BERRY via cell phone that both of parents had given their

consent to take the laptop computer and webcam to SAPD in order to make a copy of the video.
I received the laptop computer and webcam from and responded to SAPD with it after
the completion of the canvass.

is the Grandmother of . was asleep during the incident and
did not hear any gunshots. awoke her after the gunshots and she looked out the south
facing window but without her eye glasses. She did not see or hear the shooting.

niece was also in the room asleep.

was asleep during the incident and did not see or hear the shooting. She
looked out their south facing window after the incident due to the arriving police vehicles
flashing emergency lights.

was asleep when she heard (1) gunshot. Less than five minutes later he
heard (3) more gunshots. He responded to his son, S bedroom, and looked
out the west facing window which overlooks the south alley of 3005 South Bristol Street.

observed that police officers had already arrived in the alley then he stepped away
from the window because he feared more gunshots.
was asleep during the incident and did not see or hear the shooting. Her
husband awoke her regarding the police activity behind their residence.
was asleep in his bedroom, on the west side of the residence when he heard
(1) gunshot. A few seconds later he heard 3‐4 more gunshots. He peeked out the window
briefly then went to his parents bedroom and woke up his father. He then went into another
bedroom on the west side of the residence and saw police cars and at least one officer pointing
his handgun towards the ground. explained he couldnt see anything or anyone else
because the back fence blocks most of their view of the alley.
