HomeMy WebLinkAboutOIS2012-003_Initial response and officer processing - Berry_pdf_Redacted S.A. 12‐022 Investigator: Stan Berry Approved By: Date of Report: September 10, 2012 Date:  09/11/12 Page 1 of 2 ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT CASE NAME: ALMANZA, MARCELINO VALENCIA CLASSIFICATION: OFFICER INVOLVED SHOOTING  (NON‐FATAL) TYPE: INITIAL RESPONSE & OFFICER PROCESSING AGENCY: SANTA ANA POLICE DEPARTMENT On Sunday, September 10, 2012, at 0100 hours, Orange County District Attorney Supervising Investigator RON SEMAN contacted  me regarding an officer involved shooting incident involving the Santa  Ana  Police Department.  SEMAN requested  I respond to 3005 South Bristol Street, in the city of Santa  Ana, to assist with the investigation. I arrived on scene at approximately 0159 hours and met with investigators from the Orange County District Attorney’s Office (OCDA) and the Santa Ana  Police Department (SAPD), who were present to assist with the investigation. At approximately 0255 hours, Santa  Ana Police Sergeant MATT SORENSON conducted  a briefing of the known circumstances surrounding the incident for the personnel involved  in the investigation. Following the briefing, OCDA Supervising Investigator RON SEMAN directed me to team with SAPD Homicide Detective ANDY ALVEREZ to supervise the officer processing at the Santa Ana  Police Department.   ALVEREZ and I responded  to the station. At approximately 0356 hours, I witnessed Orange County Forensic Specialist LINDSEY OLSON process Santa Ana Police Officer DAVID ENRIQUEZ.  There were several people within S.A. 12‐022 Investigator: Stan Berry Approved By: Date of Report: September 10, 2012 Date:  09/11/12 Page 2 of 2 the Internal Affairs conference room during the processing, but specifically , Attorney at Law, was present to witness the processing. OLSON began the processing and took seventeen photographs and  collected  evidence under FR# 12‐53567. OLSON photographed  Officer ENRIQUEZ in his uniform and  collected  the following items: 1. Glock, model 22, 40 caliber pistol, serial number KEZ535 with a rail mounted Streamlight, Model TRL‐1, serial number C4‐204591. 2. One 15 cartridge capacity magazine from gun containing 9 cartridges and  1 cartridge from the chamber. 3. One 15 cartridge capacity magazine from duty belt containing 15 cartridges. 4. One 15 cartridge capacity magazine from duty belt containing 15 cartridges. I did  not observe and ENRIQUEZ confirmed  that he suffered  no injuries to his person nor was there damage to his uniform or equipment.  The gun, magazines, and  cartridges were photographed. It appeared  that all of the rounds collected from Officer ENRIQUEZ displayed  a head stamp of Winchester .40 S&W.
