On September 10, 2012, at approximately 0412 hours, I conducted an audio digital
recorded interview of regarding the Santa Ana Police Department
officer involved shooting related to MARCELINO VALENCIA ALMANZA.
On September 10, 2012, at approximately 0000 hours, was inside the hotel room
where he, his wife, , and their juvenile son,
, were residing. The hotel, , was located at , Santa
Ana, on the northeast corner of the intersection of South Bristol Street and West Segerstrom
Avenue. and his family were occupying room number Room number was
located on the south side of the second floor of the hotel, facing West Segerstrom Avenue. The

rooms south facing window provided an unobstructed view into the rear parking area of 3005
South Bristol Street, which was located on the south side of West Segerstrom Avenue.
was watching television when he observed a flashing light emanating from
outside their hotel room window. He responded to the window and noticed a silver Jeep
Wrangler that was parked across the street in the parking lot behind the Coin Laundry
Laundromat, located at 3005 South Bristol Street. The Jeep was parked parallel to the east wall
of the business, facing northbound towards the hotel, flashing its headlights. recognized
the silver Jeep as a vehicle he had seen in the parking lot of the hotel, earlier the previous
afternoon.
explained that earlier the previous afternoon, he and had returned to
the hotel and were parking their vehicle in the hotel parking lot. As they did so, they observed
the same silver Jeep Wrangler parked in the stall next to their vehicle. The Jeep was occupied
by a male Hispanic subject who appeared to be under the influence of drugs. The subject, who
was sweating heavily, had lazy eyes, a spot on his face and was emblazoned with tattoos.
described the tattoos as tattoos that represent pride in the Mexican heritage.
noticed a rag was draped over the steering column of the Jeep. explained
that he knew from prior experience that a rag draped over the steering column of a vehicle was
an indication that the vehicle may be stolen. explained his prior experience was during a
time in his life when he was involved in stealing and possessing stolen vehicles.
recognized the occupant of the silver Jeep as a subject who had attempted to
burglarize his hotel room several weeks prior. had been inside his hotel room with his
son when he heard a noise at the hotel room door. responded to the door and opened it
to find the subject outside the door, holding a pair of bolt cutters. The subject had been

attempting to cut off the handle of the hotel room door with the bolt cutters. The subject
made an excuse for why he was there, saying he had mistakenly chosen hotel room, and
then quickly left the area. reported the incident to the hotel owner, but did not report
the incident to the police.
, who was also familiar with the subject, had commented to that she
believed that the subject carried a firearm. referred to a bulge that was visible under
the subjects shirt and jeans on his right hip area. had noticed the bulge and thought it
was a crowbar or some kind of tool, but could not discount the object as being a firearm.
As watched from his hotel room window, he could see two subjects next to the
drivers side of the silver Jeep. One of the subjects was standing and the other was confined to
a wheelchair. believed the subject who was standing next to the silver jeep was the
same subject he had seen earlier the previous afternoon in the parking lot. The subject was
later identified as MARCELINO VALENCIA ALMANZA. The subject in the wheelchair was later
identified as . knew by the nickname ,
since had a reputation for selling illegal drugs; methamphetamine and crack cocaine.
was known to sell those drugs from behind 3005 South Bristol Street.
As watched ALMANZA and , he could see what appeared to be a
cigarette lighter being used between the two subjects. assumed the use of the cigarette
lighter was to smoke crack cocaine. decided to report the incident to the Santa Ana
police.
called the Santa Ana Police Department (SAPD) and reported that he believed
ALMANZA and may be involved in the use of illegal drugs and that the silver Jeep, that
was in ALMANZAs possession, was stolen.

Approximately 4 minutes after placed the telephone call to the SAPD, he
observed a police patrol vehicle enter the south end of the parking lot, from South Bristol
Street, and drive eastbound to the south end of the building located at 3005 South Bristol
Street. As the patrol vehicle passed the south end of the building, it began to drive northbound
towards the rear of the building; towards where ALMANZA and were located. At that
time, ALMANZA was standing and was seated in his wheelchair next to the drivers
side of the Jeep. Both doors on the drivers side of the vehicle were open.
The patrol vehicle stopped just southeast of ALMANZA and location. A police
officer, later identified as Officer DAVID ENRIQUEZ, exited the vehicle and walked around to the
front of the patrol vehicle. ENRIQUEZ began speaking to ALMANZA and from a
distance. could hear the conversation from his hotel room window.
ENRIQUEZ asked the subjects, Whats going on tonight?, let me see your hands, I just
need to talk to you. ALMANZA ignored ENRIQUEZ and ran over to the Jeep. ALMANZA leaned
into the drivers side, rear passengers door of the vehicle and began to rifle through its
contents. ALMANZA appeared to be retrieving an object from the rear seat of the vehicle.
ALMANZA appeared to wrap a rag or cloth around the object he had in his hand. ENRIQUEZ
began yelling at ALMANZA, Hey, let me see you hands. What are you doing? Dont do it.
ALMANZA, who was still ignoring ENRIQUEZ, ran from the rear passengers door to the front of
the Jeep, still in possession of the object that was wrapped in the rag. ENRIQUEZ drew his
firearm at that point.
Once ALMANZA reached the front of the vehicle, he stood facing southbound towards
ENRIQUEZ, and brought both of his arms up in front of him. ALMANZA brought his hands

together, cradling the object in his hands. was unable to identify the object; however,
based on the way ALMANZA was holding the object, believed it was a firearm.
ALMANZA was crouched down at the front of the Jeep, using the Jeep as cover.
ALMANZA kept bobbing his head up and down in front of the vehicle, in an attempt to see
where ENRIQUEZ was located. ENRIQUEZ continued to yell commands at ALMANZA.
described ALMANZA as being argumentative with ENRIQUEZ, as ENRIQUEZ yelled
commands at ALMANZA. ALMANZAs response to ENRIQUEZs commands was No! No! At
one point, ENRIQUEZ told ALMANZA to get on the ground. ALMANZA responded by stating,
No, you do that.
From ENRIQUEZs location, in front of the patrol vehicle, ENRIQUEZ fired his firearm
twice at ALMANZA; however, believed that ALMANZA was not struck by the bullets.
ENRIQUEZ then began to move in a northeasterly direction. ALMANZA lay on the ground and
crawled under the front of the Jeep, where he continued to watch ENRIQUEZ from below the
front of the vehicle. While lying below the front of the vehicle, ALMANZA constantly groped his
right pants pocket area, as though he was attempting to retrieve an item from his pants pocket.
ENRIQUEZ continued moving in a northeasterly direction on the passengers side of the
Jeep. As he did so, ENRIQUEZ continuously issued commands to ALMANZA; Let me see your
hands, Lay flat on the ground, Put your hands flat on the ground. ALMANZA did not
comply with ENRIQUEZs commands and continued to reach towards the pocket of his pants.
After groping the pocket of his pants, ALMANZA brought his hands back together in front of
him, as though he was pointing a firearm at ENRIQUEZ.
When ENRIQUEZ stopped moving in a northeasterly direction, he was approximately 15
to 20 feet east of the front of the silver Jeep. From that location, ENRIQUEZ fired two more

rounds from his firearm at ALMANZA. Based on ALMANZAs reaction, believed ALMANZA
was struck by the bullets. ALMANZA began to scream in pain and began yelling out to
ENRIQUEZ, Okay, Im sorry. I didnt mean to, Im just scared. ENRIQUEZ advised ALMANZA to
lay still, that help was on its way.
ENRIQUEZ continued to point his firearm at ALMANZA from a safe distance, until
assisting police officers arrived on scene. Once additional police officers arrived on scene,
left his hotel room to identify himself as the reporting party to the police officers.
At no time during the incident did see ENRIQUEZ make physical contact with
ALMANZA.
