On Wednesday, June 26, 2013, at 0900 Hours, District Attorney Investigator Loren
Dawson #256 and I attended the post-mortem examination of Jessica Gonzalez at th e
Orange County Coroner's Office. Investigator Dawson and I viewed the examination
from a v iewi ng room w i t h a window and closed circuit television, which a ll owe d us to
see the procedure.

briefed the medical t eam as to the circumstances known to u s as a result of th e

preliminary investigation into this case.
I observed the decedent to be encased in a white body bag inside the autopsy room. Once
the bag was opened, I observed an adult Hispanic female inside. The decedent resembled
the photograph of Jessica Gonzalez. The decedent was placed on the table, nude, in a
supine position. I saw a coroner 's toe tag on her left foot. The decedent's hands were
encased inside brown paper bags. I observed the body to have numerous small bruises,
predominantly on her lower extremities, consistent with intravenous drug use. The
decedent's left chest cavity was visible tlu·ough a thoracotomy incision. I observed
various items of medical paraphernalia attached to the decedent from medical
intervention efforts. Once flipped over, I observed a tattoo across the top of her upper
back/lower neck, which read " and a tattoo of a
on her right rear shoulder. I also observed apparent gunshot wounds throughout
the decedent's upper torso.
Dr. Davenport told us that Gonzalez died as a result of gunshot wounds. Dr. Davenport
identified four gunshots to the decedent. One gunshot was to the right forearm, which
broke the bones in her forearm. Bullet fragments were seen in the X-ray but not removed.
The next gunshot entered on the top of the right biceps, exited the inner right bicep s, and
re-entered the body at the right armpit. The next gunshot entered at the right rear shoulder
and exited the left flank. The last gunshot entered at the left back and exited the lower
right back. The gunshots described are not in sequential order. Dr. Davenport remo ved a
bullet core and bullet fragm e nts from the lower spinal column. The projectiles were
retained as evidence by the Orange County Sheriff-Coroner Department.
The post-mortem examination concluded at approximately 1230 Hours.

I was contacted by Sergeant Javier Esparza# 1568 of the Santa An a Police Department H omicide
Section who informed me that an officer involved shooting incident occurred at 805 S . Townsend St.
Sergeant Esparza r equ ested I res pond and ass ist w ith the in vestigation .
1045 Hours
T arrived at th e scene and ch ecked in w ith Officer R. Ribeiro #3224, who was maintaining the crime
scen e log.
1055 Hours
Serg eant P . Craft #2979 briefed us on the circumstances of the offi cer involved shooting . After the
briefing, I was assigned t o attend the processing of the offi cers involved in the incident at the San ta Ana
Police Department.
1110 Hours
I cleared the scene and returned to the Santa Ana Police D epartment.
1313 Hours
I att ended the office r processing which was conducted in an inte rview room, located in the Santa Ana
P olice Department Professional Standards Bureau. Present in the room we re Orange Coun ty Di strict
Attorney Investigator Brad Tanner, Santa A na Police Sgt. J. Gonzalez #25 93 , SAPOA Attorney D .

was wearing a Santa Ana Police Department uni form , w h ich had Santa Ana Police patches o n bot h the
right and left s leeve. H is uni fo rm consisted of a Police Officer badge o n his left breast, his name tag on
his right breast , Sam bro wn duty belt, which contained his hol stere d service weapon , two s ingl e
handcuff case, key h o lder, baton r esting ins id e of baton ring, p o rtable radio , p epp e r spray , an d
ammunition pouch. H e had a pair of b lack gloves in hi s ri gh t rea r p ants flashli gh t pocket, a metal folding
pocket knife in his left rear pants fl ashli ght pocket and a backup weapon in h is left rear pants pocket.
Officer Ayala did not have a ny injuries, nor d id his uniform have a ny indication of wear or damage
caused by the inc ident.
Officer Aya la carries a d epartme nt issued Glock 22 40 cali ber semi-aut omatic handgun w ith serial
#LXN640. There was a Stream li gh t TLR gun li g ht, ser ial #C4-35256509 12, attached to th e gun. He
carri es 3 de partme n t issu e d g un m agazines and each m agazine holds 15 cartridges. On duty , the g un is
loaded with one cartridge in the ch amber and 15 cartridges in th e magazine. During the cartridge co unt ,
the hand gun contained one cartridge in the chamber and seven (7) cartridges in the magazi n e. T he two
magazines on the duty belt each contained 15 cartridges. Each cartri dge h ad a head stamp of
"Wincheste r 4 0 S&W.
Officer Ayala's backup weapon was a Smith & Wesso n .380 Semi-auto, model : Body Gua rd 380, serial
#EBI0446 . The gun was loaded w i th o ne cartridge in the c hamber and 6 cartridges in th e magazine.
During th e cartridge count, the gun con ta ined one ca1iridge in the c hamber and s ix (6) cartridges in the
magazine. Each cartridge had a head stam p of "H ornady 380 Auto." Officer Ayala kept possess ion of
hi s backup weapon .

I was contacted by Commander Colon # 1969 of the Santa Ana Police Department, who advised me of
an Officer Involved Shooting that had occurred at 800 S. Townsend Street in the City of Santa Ana.
Commander Colon requested I responded and assist with the investigation .
1022 Hours
Sergeant Esparza #1568 provided a briefing to detectives as to the known details. I was informed I
would be assisting with canvassing the neighborhood.

I arrived at the crime scene and checked in with Officer Ribeiro #3224, who was maintaining the crime
scene personnel entry log.
1050 Hours
Sergeant Craft #2979 gave a briefing about the officer involved shooting and the status of the initial
investigation by patrol officers. Present were Detectives from the Santa Ana Police Department,
Investigators form the Orange County District Attorney's Office, and members from the Orange County
Crime Lab. At the conclusion of the briefing, I was assigned to assist Orange County District Attorney
Investigator Bob Erickson with a canvass of the neighborhood for witnesses.

The three locations are two story apartments.
We contacted the residents in apartment # told me she was in bed at about 0800 hours.
She was awake when she heard 7-10 gun shots. She did not hear anything further and walked out of her
apa11ment about 30 minutes later to find the police in the west alley. She did not see anything further.
told me she was lying down in the living room when she heard 7 gun shots. She heard
the police sirens shortly thereafter and remained in her apartment. She had nothing further to add.

We contacted the residents in apartment to ld me she was asleep in her bedroom at
about 0800 hours. She was awakened by gun shots. She could not tell how many gun shots she heard
and went back to sleep. She had nothing fmther to add .
said she was asleep in the living room when she was awakened by gun shots. She heard
about 10 gun shots. She did not go outside to investigate and went back to sleep.
said he was asleep in the living room when his sister, awo ke him. She told him she
had just heard several gunshots. He did not hear anything and went back to sleep.
was asleep in his bedroom when he awoke to what he believed to be fireworks being
fired. He heard 2-3 bangs. H e had nothing further to add.

left the apartment at about 0400 hours and was not home at 0800 hours. He was not available to
give a statement.

We co n tacted the residents in apartment . At about 0800 hours, was as leep in her
bedroom when sh e was awakened by w hat she be li eved to be firework s. She did not investigate any
further.
At about 0800 hours, was in the kitchen when she heard about l O gun shots. She
heard gun shots from two directions and then heard someone yelling in English. She could not tell what
the person was say ing because she does not speak English. is a Spanish speaker. She did not
investigate any further.
There was no response.
We contacted the residents in apartment At about 0800 hours, was sitt ing in the living
room watching te levision when she heard more than 10 gun shots. Several minutes later, she l ooked out
of her window and saw numerous poli ce officers in the alley. About 10 minutes later, she walked out of
her apartment and saw a body lying in the alley . She was fr ightened and went back to her apartment. She
had nothing further to add.
At about 0800 hours, was sitting in the living room watching television when he heard
what he believed to be fireworks. He heard two different so unds be li eving they were fireworks. About 5
minutes later, he walked outside and saw a po lice unit parked in th e a ll ey. He walked back to his
apartment and remaine d ins id e. He had nothing further to add.
At about 0800 hours, was asleep in her bedroom when she heard 10 gun shots. Sh e heard
two d iffe rent sounds believing they were two different calibers. She had nothing further to a dd.
At about 0800 hours, was asleep in hi s bedroom whe n he heard what he belie ved to be
fir eworks. Ri ght after the fireworks, he heard some screaming. He could not te ll what was being said
and remained in bed.

We contacted t he re sidents in apartment At about 0800 hours, was asleep in his
bedroom when he heard 5-6 gun shots. He stayed in bed after he ar ing the gun shots. had nothing
further to add.
At about 0800 hours, was asleep in his bedroom when he hea rd w hat he believed to be
fire works being set off. remained in bed and did not hear anything furthe r.

turned towards the east alley to see police officers walking south through the a ll ey with the ir guns
drawn. did not see anything further and walked back inside of his apartment. said he lives
by himself.
We contacted . At about 0800 hours, was in her living room with her children when
she heard 5-10 gun shots . She did not hear anything else and remained inside of her apartment. Her
husband, , was not home at the time.

awakened by gunshots. She heard 5 gunshots and an unknown male from an unknown apartment yell,
"Everybody get down." grabbed her daughter, and remained in bed. Seconds later, she
walked out of her bedroom and saw her mother, looking out of the bathroom window.
