Erickson #238 Approved By: Date of Report: 9/9/13 Date: 10/28/2013 Page 1 of 13 CASE NAME: GONZALEZ, JESSICA CLASSIFICATION: OFFICER INVOLVED SHOOTING - FATAL TYPE: CANVASS AGENCY: SANTA ANA POLICE DEPARTMENT On Sunday, June 23, 2013, at approximately 0910 hours, Orange County District Attorney Supervising Investigator MARK GUTIERREZ contacted me regarding an officer involved shooting incident involving the Santa Ana Police Department. GUTIERREZ requested I respond to the area of 809 South Townsend Street, in the city of Santa Ana, and assist with the investigation. At approximately 1020 hours, I arrived at the incident location and met with investigators from the Orange County District Attorney’s Office and from the Santa Ana Police Department who were present to assist in the investigation. At 1050 hours, Santa Ana Police Sergeant PHIL CRAFT conducted a briefing of the known circumstances surrounding the incident for the personnel involved in the investigation. Following the briefing, GUTIERREZ assigned Santa Ana Police Detective FRANK GOMEZ and me to team up and conduct canvass interviews of potential witnesses. GOMEZ is a certified Spanish interpreter for the Santa Ana Police Department. Many of the people we contacted during our canvass were Spanish speakers. During the canvass, GOMEZ and I conducted audio digitally recorded interviews of the following individuals: ORANGE COUNTY DISTRICT ATTORNEY’S OFFICE BUREAU OF INVESTIGATION SUPPLEMENTAL REPORT S.A. 13-015 Investigator: R. She did not hear or see anything else. was lying down on her bed in the living room when she heard approximately seven to ten gunshots. She did not hear or see anything else. was sitting in the living room when she heard approximately seven to ten gunshots. She did not hear or see anything else. was inside of the apartment when he heard one gunshot. He did not see or hear anything else. At the time of the shooting, was inside of the apartment asleep. She woke up to the sound of several gunshots. She did not see or hear anything else. was asleep on the living room couch when she woke up to the sound of approximately ten gunshots. She did not see or hear anything else. was asleep at the time of the shooting, and did not see or hear anything. was asleep in his bedroom when he woke up to the sound of what he believed to be two to three fireworks. He did not see or hear anything else. was home, but unavailable at the time of the initial canvass. I contacted her at a later date and her statement is reported later in this canvass report. Her husband,, left for work at approximately 0400 hours. did not see or hear anything, and slept through the shooting incident. Her son, , was home at the time of the incident, but he left the apartment before we arrived on our canvass. was sleeping in her bedroom at the time of the shooting. She woke up to the sound of what she thought were fireworks, and did not see or hear anything else. At the time of the shooting, was cooking in her kitchen. She heard approximately ten gunshots. After the gunshots, she heard male voices yelling something in English that she could not understand. She did not see or hear anything else. was sitting in her living room watching television with her husband, when she heard approximately ten gunshots. She looked out her window towards the alley and she saw two or three police officers walking in the alley. She did not see or hear anything else. S.A. 13-015 Investigator: R. He later realized that it was probably two different types of guns being fired. He did not see or hear anything else. was in her bedroom when she was awakened by the sound of gunshots. She heard approximately five gunshots, followed by the sound of approximately two to five more gunshots that sounded slightly different than the first five. She got up out of her bed and looked out her window. She saw police officers walking south in the alley. She did not see any portion of the shooting. She did not see or hear anything else. was in his bedroom asleep when he woke up to the sound of what he thought were fireworks. He also heard some voices screaming something after the shooting, but he could not tell what was being said, or who was screaming. He did not see or hear anything else. was asleep in his bedroom when woke up to the sound of five or six gunshots. He did not see or hear anything else. was awake in his bed when he heard what sounded like six or seven fireworks. He did not see or hear anything else. S.A. 13-015 Investigator: R. He did not see or hear anything else. was asleep in her bedroom when she woke up to the sound of approximately six gunshots. She did not see or hear anything else. was asleep in his bedroom when he woke up to the sound approximately eight to ten gunshots. Immediately after the gunshots, he heard sirens and police radios. He did not see or hear anything else. was asleep in the apartment when he woke up to the sound of five or six gunshots. He did not see or hear anything else. was asleep in the living room when he woke up to the sound of approximately six to eight gunshots. He did not see or hear anything else. was asleep in the apartment at the time of the shooting incident. She slept through the entire incident, and did not see or hear anything. was asleep in her bedroom when she woke up to the sound of approximately six fireworks. She did not see or hear anything else. was asleep in his bedroom when he woke up to the sound of what he believed to be fireworks. He did not see or hear anything else. S.A. 13-015 Investigator: R. She then heard police arriving in the area. She did not see or hear anything else. was asleep at the time of the incident. He did not wake up and, therefore, did not see or hear anything. was not present at the time of the canvass. Per his wife, left for work 0600 hours, and was not home at the time of the incident. was inside of her apartment at the time of the shooting. She was trying to find a DVD to play for her young children ) when she heard approximately seven to eight fireworks. She did not go outside to see what had happened. She did not see or hear anything else. was asleep in his apartment when he heard what he thought were approximately seven fireworks. He also heard some sirens, but he then fell back asleep and did not see or hear anything else. were all away from their apartment when the shooting happened. No one was home at the time of the shooting, and none of them saw or heard anything related to the shooting incident. was asleep in the apartment when she woke up to the sound of approximately five to ten gunshots. She did not see or hear anything else. was asleep in the apartment when he woke up to the sound of approximately nine to ten gunshots. He did see or hear anything else. was asleep in the apartment when she woke up to the sound of what she thought were approximately ten fireworks. She did not see or hear anything else. was also asleep in the apartment when he woke up to the sound of approximately seven gunshots. He did not see or hear anything else. was home alone at the time of the shooting. He was awake when he heard what he thought were eight to nine fireworks. After the fireworks, he heard a female screaming. Approximately two to three minutes later, he went outside and saw several police officers in the area around the apartment building and the alley. wife and children were not home at the time of the incident. She looked out her bedroom window and did not see anything. She got out bed and went to look out her front window. She saw several police officers out in the courtyard area of the apartment building. husband, had left the apartment to go to work before the incident occurred. children were inside the apartment asleep during the incident. Per the children did not wake up when the incident occurred. was in her bedroom asleep with her daughters when she woke up to the sound of approximately five gunshots. She heard a neighbor yell, “Get down.” grabbed her daughters ( and got down on the bedroom floor. She did not see or hear anything else. was asleep with her mother when she woke up to the sound of approximately four gunshots. She got down on the floor with her mother and did not see or hear anything else. were also present in the apartment when the incident occurred, but they were not home at the time of the initial canvass. Erickson #238 Approved By: Date of Report: 9/9/13 Date: 10/28/2013 Page 9 of 13 On June 27, 2013, at approximately 1637 hours, I conducted a follow-up canvass in the same apartment buildings with Orange County District Attorney Investigator FRANK REYNOSO. REYNOSO is a certified Spanish language interpreter for the Orange County District Attorney’s Office. During our canvass on that date, Reynoso and I conducted audio digitally recorded interviews of the following individuals: was asleep in the north bedroom of her apartment when she woke up to the sound of approximately four gunshots. She did not get out of bed to see what had happened. She did not see or hear anything else. was in bed asleep at the time of the incident. He did not wake up when the incident occurred. was asleep in her living room when she woke up to the sound of approximately ten gunshots or fireworks. She was not sure what she was hearing initially, but then she heard someone say something like, “Stop.” The living room window was open and after the initial gunshots, she could hear the footsteps of someone running in the alley. She then heard approximately five more gunshots. She eventually got up and looked out the S.A. 13-015 Investigator: R. Erickson #238 Approved By: Date of Report: 9/9/13 Date: 10/28/2013 Page 10 of 13 window that faced the alley, but she could not see anything from that vantage point. were asleep with her at the time of the shooting. was in the north bedroom of the apartment watching television. Her bedroom window was open. She heard four quick loud bangs, which she thought were fireworks. After just a moment, she heard another group of loud, rapid, bangs. She then heard what she thought was the voice of a male police officer speaking in English. She did not understand what he was saying. She got up and looked out her bedroom window and saw people outside in the alley. She did not see any portion of the actual shooting. It was over by the time that she got up to look out her window. was not home at the time of the shooting. She left her residence before 0700 hours, to go to work that morning. was not home at the time of the shooting incident. He drove to work that morning and then went on to his own workplace for the day. was awake in bed in the back bedroom with her mother when she heard voices of what she believed to be police officers telling someone in English, “Put your hands up.” Immediately after that, she heard approximately four gunshots. She did not see any portion of the shooting. was in the living room of the apartment when she heard approximately eight loud bangs which she believed to be fireworks. Approximately three minutes later, her daughter, came out of the back bedroom. She looked afraid. asked her if she had heard the gunshots. asked her if she meant fireworks. said, “No, those were gunshots.” and then looked out the window and saw that many of the neighbors were outside in the courtyard looking around. did not see or hear anything else related to the shooting incident. was asleep on the living room floor. She woke up to the sound of approximately eight gunshots. She got up approximately five minutes later and looked out the window, and saw several police officers outside. On July 2, 2013, I conducted a second follow-up canvass in the apartment buildings with Orange County District Attorney Investigator JOHN MERCADO. MERCADO is a certified Spanish language interpreter for the Orange County District Attorney’s Office. During this follow-up canvass, MERCADO and I conducted audio digitally recorded interviews with the following individuals: S.A. 13-015 Investigator: R. They were all praying together in the bedroom. While they were praying, heard several gunshots, and did not hear or see anything else. was in the bedroom with his mother praying when he heard approximately thirteen gunshots. He did not see or hear anything else. at work at the time of this follow-up canvass. Per was in the bedroom with the rest of the family at the time of the shooting and he also heard the gunshots. did not see or hear anything else. and were not home at the time of this follow-up canvass. They were also with at the time of the incident. Per they also heard the gunshots, but did not see or hear anything else. On July 26, 2013 at approximately 1532 hours, I returned to the area of the shooting and conducted an audio digitally recorded interview with the following individual: was in her bedroom asleep at the time of the incident. She did not wake up when the shooting occurred. She did not see or hear any portion of the incident. On August 16, 2013, at approximately 0710 hours, I returned to the area of the shooting for one last canvass follow-up. He did not get out of bed to see what happened, and did not see or hear anything else.
