Narrative: Sunday: 06/23/13 0825 Hours I was home when I was contacted by Sergeant Carrillo #2175 of the Santa Ana Police Department Gang Unit. Sergeant Carrillo informed me of an Officer Involved Shooting and requested I assist with the investigation. 1022 Hours Sergeant Esparza #1598 briefed the assisting Detectives on the circumstances surrounding the Officer Involved Shooting . Sergeant Esparza informed Detectives the shooting occurred in the east alley of 800 S. Townsend Street. Detective L. Rodriguez #2408 was designated as the case agent. I was assigned to assist in canvassing the neighborhood. 1045 Hours I arrived to the scene of the Officer Involved Shooting. I entered the scene from the south perimeter and checked in with Officer Ribeiro #3224 who was maintaining a crime scene personnel log. 1050 Hours Sergeant Craft #2979 gave a briefing about the officer involved shooting and the status of the initial investigation by patrol officers. Present were Detectives from the Santa Ana Police Department, Investigators from the Orange County District Attorney's Office, and members from the Orange County Crime Lab . At the conclusion of the briefing, I was assigned to assist Orange County District Attorney Investigator Ed Wood with a canvass of the neighborhood for witnesses. Townsend Street and 809 S. Townsend Street. Each of these apartment complexes are two story buildings. 809 S. Townsend Street, 1111 Hours -Apartment #6 Rosa Garcia told us she was in bed at about 800 hours this morning. She got out of bed when she heard the sound of several gunshots. She looked outside from her apartment and saw several of her neighbors come out of their apartment. She did not go outside and did not see anything further. No statement was taken from Garcia's young children, ages 2, 8, and 9. Apartment #7 Esperanza Orduna explained that she is in the process of moving out of her apartment. She told us that she arrived back to the apartment at about 0830 hours. Orduna explained that at that time, the alley was already blocked off by officers. She did not see anything further. Apartment #8 Mirna Reyes told us she was asleep in her bedroom this morning when she was awakened by the sound of about 8 gunshots. She did not go outside and did not see anything further. Mirna explained that her three teenage sons were also home at the time of the shooting. However, they left the apartment prior to our arrival. Mirna stated that her sons were also awakened by the sound of the gunshots. Mirna stated that her sons remained in the apartment after the shooting. Sofia Gonzalez explained that she is a friend of the residents and slept over last night. Gonzalez told us she was asleep on the living room sofa this morning when she was awakened by the sound of about 8 gunshots. She did not go outside to investigate the gunshots. Apartment #9 There was no response. Apartment #10 Maria Gutierrez told us she was asleep in her bedroom this morning when she was awakened by the sound of an unknown number of gunshots. Gutierrez stated this occurred at about 0800 hours. Maria stated she did not go outside to investigate the gunshots. Miriam Silva explained that she shares a bedroom with her sons, Luis and Miguel. She told us she was awakened this morning by the sound of about 7 gunshots. She did not go outside to investigate the gunshots. Luis stated he stepped out onto to the apartment's 2nd floor walkway to investigate. Luis did not see anything further. Miguel Gonzalez told us he was asleep in his bedroom this morning when he was awakened by the sound of the gunshots. Miguel stated he also stepped out onto to the apartment's 2 nd floor walkway to investigate. Miguel did not see anything further. Apartment #5 There was no response. Apartment #4 Carmen Mejia told us she was asleep in her bedroom this morning when she was awakened by the sound of the gunshots. Gutierrez stated this occurred at about 0800 hours. Maria stated she did not go outside to investigate the gunshots. Jesus Pena told us he was asleep when he was awakened by the sound of about 8 gunshots. Jesus did not go outside to investigate the gunshots. Jesus Pena (Sr.) told us he was at work at the time of the shooting. Jesus was told of the shooting by his family. Apartment #3 There was no response . Apartment #2 Guadalupe Dominguez told us she was asleep in her bedroom when she was awakened by an unknown number of gunshots. She did not go outside to investigate the gunshots. Apartment #1 Veronica Leyva told us she was asleep in her bedroom this morning when she was awakened by the sound of about 10 gunshots. Veronica explained this occurred at about 0720 hours. Veronica stated she did not go outside to investigate the gunshots. Gladis Victoriano told us she was asleep in her bedroom this morning when she was awakened by the sound of about 10 the gunshots. Gladis stated she did not go outside to investigate the gunshots. We were told resident Juanito Tibursio was also asleep in the apartment at the time of the gunshots. However, he left for work prior to our arrival. We were unable to get a statement from him. 805 S. Townsend Street Apartment #1 8/13/2013 Santa Ana PD 20 I 3-17495: O1S by #2884 Page 13 of 17 Sylvia Martinez told us she was asleep in her bedroom this morning when she was awakened by the sound of unknown number of loud bangs. Sylvia did not know if the sounds were gunshots or fireworks. Sylvia stated she did not go outside to investigate the gunshots. Francisca Cortez told us she was asleep in her bedroom this morning when she was awakened by the sound of unknown number of loud bangs. Sylvia did not know if the sounds were gunshots or fireworks. Francisca stated she did not go outside to investigate the gunshots. Apartment #2 Eleuterio Gaytan told us he was asleep in his bedroom this morning when he was awakened by the sound of about 15 gunshots. Eleuterio heard the gunshots at about 0800 hours. He did not go outside to investigate the gunshots. Carina Ibarra told us she was asleep in her bedroom this morning when she was awakened by the sound of about 15 gunshots. Carina heard the gunshots at about 0800 hours. She did not go outside to investigate the gunshots. Apartment #3 Wendy Luna told us she was asleep in the bedroom when she was awakened by an unknown number of loud bangs. Wendy did not know if the sounds were gunshots or fireworks. This occurred at about 0815 hours. She did not go outside to investigate the gunshots. Nicole Luna told us she was asleep in her bedroom when she was awakened by an unknown number of loud bangs. Nicole did not know if the sounds were gunshots or fireworks. This occurred at about 0815 hours. She did not go outside to investigate the gunshots. Omar Flores told us he was at work at the time of the shooting. Omar was told of the shooting by his family. Apartment #4 Marisol Pineda told us she was asleep her bedroom when she was awakened by the sound of about 3 gunshots. Marisol stated this occurred at about 0805 hours. She did not go outside to investigate the gunshots. Mirna Pineda told us she was asleep in the living bedroom when she was awakened by the sound of about 8 gunshots. She did not go outside to investigate the gunshots . Apartment #5 Apartment #5 is the furthest east, first floor, apartment at this address. This apartment is the closest to the garages and east alley of Townsend Street. Apartment number #5 has a kitchen window that faces east toward the garage and east alley. At the time of this incident, there were five vehicles parked in front of kitchen window. Jeffrey Mika was present at the apartment at the time that we made contact with the residents . Victoria stated she was not sure if the sounds were fireworks or gunshots. After being awakened, Victoria went to the kitchen and looked out from its east facing window. Victoria stated she heard officers talking to someone . Victoria stated she was not sure how many officers were present, possibly 5 to 6 . Victoria did not know what the officers were saying and who they were talking to. She did not go outside to investigate the gunshots. Daniel Antunes told us he was asleep the living room when he was awakened by the sound of about 8 gunshots. After being awakened, Daniel went to the kitchen and looked out from its east facing window. Daniel explained that he saw part of marked police vehicle stopped in the alley. From the window he heard someone yell, about three times, "Stay on the ground" and "She has a gun." Daniel stated that he could not see who was yelling, but believed it was an officer. He did not go outside to investigate the gunshots. Luis Arias told us he was asleep the living room when he was awakened by the sound of an unknown number of loud bang sounds. Luis stated he was not sure if the sounds were fireworks or gunshots. After being awakened, Luis stated that he did not immediately go to the kitchen window. When Luis went to the window, he observed an officer directing pedestrians out of the area. He did not go outside to investigate the gunshots. Jessica Temores told us she was asleep the living room when she was awakened by the sound of about 3 gunshots. Jessica explained that after a brief pause (about 3 seconds) she heard approximately 4 additional gunshots. After the shooting had stopped, Jessica got up and went to the kitchen window. Jessica explained that from the window she could a marked police vehicle stopped in the alley. Jessica stated that she heard two voices yell, "Get on the ground" and "she has a gun." Jessica stated that she could not see who was yelling, but believed it was the officers. She did not go outside to investigate the gunshots. Telesforo Antunes explained that while he was cleaning his apartment when heard an unknown number gunshots in the east alley. This occurred at about 0800 hours. Telesforo went to the kitchen and looked out from its east facing window. Telesforo explained that from the window he could see a marked police vehicle stopped in the alley. Telesforo stated that he could not see the officers, but heard the officers speaking loudly to someone in English. Telesforo does not speak English. He did not go outside to investigate the gunshots. Apartment #6 Apartment #6 is the furthest west, second floor, apartment at this address . This apartment is the furthest apartment from the garage and east alley of Townsend Street. Alejandro Apolonio explained that this morning, at about 0700 hours, he was standing just outside his 2 nd floor apartment's door. Alejandro stated that as he stood outside, he saw a police vehicle arrive in the alley. Alejandro explained that shortly after the police vehicle arrived, he heard the sound of about 18 gunshots. Alejandro stated that he did not see the shooting and did not hear anyone talking or arguing before or after the gunshots. Alejandro did not go to the alley to investigate the gunshots. I stepped out of the apartment with Alejandro and had him show me where he was standing at time he observed what he had just described.
