On Tuesday, July 30, 2013, at approximately 1518 hours, Orange County District
Attorney (OCDA) Supervising Investigator MARK GUTIERREZ contacted me regarding an officer
involved shooting incident involving the Santa Ana Police Department (SAPD). GUTIERREZ
requested I respond to 622 South Harbor Boulevard, in the city of Santa Ana, and assist with the
investigation.
At approximately 1605 hours, I arrived at the incident location and met with
investigators from OCDA and SAPD who were present to assist in the investigation.
At approximately 1631 hours, SAPD Acting Sergeant OLIVER GRANT conducted a briefing
of the known circumstances surrounding the incident for the personnel involved in the
investigation.
Following the briefing, GUTIERREZ assigned SAPD Detective ANTONY NGUYEN and me to
team up and conduct canvass interviews of potential witnesses that lived or worked in the
immediate area of the shooting incident. During our canvass of the area, NGUYEN and I
conducted audio digital recorded interviews of the following individuals:

Nady’s Liquor, 652 South Harbor Boulevard, Santa Ana, CA 92704
was the Owner of Nady’s Liquor. On July 30, 2013, at approximately
1500 hours, was the only person working at the business. was behind the
front counter when he looked out the front glass door, located on the east side of the business.
The front glass door had a view of the parking lot on the east side of the business, and the
north side of McDonald’s Restaurant. observed a male Hispanic, heavy set, 26 years,
wearing a gray T-shirt and light brown or beige pants, run from the southwest entrance of the
parking lot at McFadden Avenue, northeast across the parking lot, to the front of China King
Restaurant, located at 624 South Harbor Boulevard, and then out of sight. A police
vehicle with emergency lights and siren on, chased the subject through the parking lot towards
China King, and then out of sight.
advised that he recognized the subject from the area, and the subject
purchased alcohol 3 to 4 times per day from his business. advised that he heard from
unidentified people that the same subject was involved in a fight earlier in the day, but the
police were not notified of the incident. did not witness or hear anything else related
to the shooting incident. did not have a surveillance video system at his business.
Estrellas Mexican Restaurant, 650 South Harbor Boulevard, Santa Ana, CA 92704
was the Owner of Estrellas Mexican Restaurant. At the time of the
incident, was in the kitchen and he did not witness or hear anything related to the
shooting incident. did not have a surveillance video system at his business.

Thai Way, 648 South Harbor Boulevard, Santa Ana, CA 92704
was the Owner of Thai Way Restaurant. On July 30, 2013, at
approximately 1400 hours, was inside her business, when she looked out the front
glass door and observed a female police officer driving westbound in the parking lot towards
the front of her business. The female police officer made a left turn, southbound in the parking
lot towards McFadden Avenue. The female police officer stopped and drove in reverse
northbound in the parking lot, out of sight.
Approximately 5 minutes later, observed a male police officer driving
westbound in the parking lot towards the front of her business. The male police officer made a
left turn, southbound in the parking lot towards McFadden Avenue, out of sight.
did not witness or hear anything else related to the shooting incident.
only had interior video surveillance, and it did not show the exterior of the business.
was the Chef at Thai Way Restaurant. SMITS started work at 1030 hours
and she was inside the business at the time of the shooting incident. SMITS did not witness or
hear anything related to the shooting incident.
was the Waitress at Thai Way. On July 30, 2013, at approximately 1400
hours, was inside the business looking out the front glass door. observed a
female police officer driving westbound in the parking lot towards the front of Thai Way. The
female police officer had emergency lights and siren on in her police vehicle. The female police

officer turned left, southbound in the parking lot towards McFadden Avenue, out of
sight. did not witness or hear anything else related to the shooting incident.
translated Thai during the interview. was a Chef at Thai
Way Restaurant. started work at 1030 hours and she was in the kitchen at the time of
the incident. did not witness or hear anything related to the shooting incident.
China King, 624 South Harbor Boulevard, Santa Ana, CA 92704
was the Cashier at China King Restaurant. On July 30, 2013, at
approximately 1500 hours, was on a break and leaning against the northeast wall of
Jugo La Tropicana, located at 622 South Harbor Boulevard. was facing northbound,
when he heard a male subject run up from behind him, turn left in front him, and run into the
north entrance of Jugo La Tropicana. described the male subject as “Chubby” wearing a
black T-shirt. immediately saw a police vehicle, with the emergency lights on, drive
northbound in the parking lot on the east side of Jugo La Tropicana, turn left in front of Jugo La
Tropicana and immediately stop in the roadway. The vehicle, later identified as SAPD vehicle
#836, was stopped facing westbound near the north entrance of Jugo La Tropicana. A female
police officer exited the driver’s seat, and she withdrew a handgun from her holster with an
unknown hand. immediately turned away from the female officer and walked
southbound along the east side of the building. heard the female police officer stated
one to two times, “Get down, get down on the ground,” and a subject stated, “Bitch.”
then heard one gunshot. did not witness or hear anything else related to the shooting
incident. did not have a surveillance video system at the business.

was a Food Preparer for China King Restaurant.
started work at 1100 hours, and he was cutting meat in the kitchen when
the incident occurred. did not witness or hear anything related to the
shooting incident.
was a Worker for China King Restaurant. On July 30, 2013, at approximately
1500 hours, was washing his hands in the sink, when he heard one noise. described the
noise as a firecracker. walked to the east glass door, opened the door, and observed a
police vehicle parked north of the business. did not witness or hear anything else related to
the shooting incident.
was a Cook for China King Restaurant. On July 30, 2013, at approximately 1400
hours or 1500 hours, was frying food in the kitchen, when he heard police sirens outside the
business. then heard one noise, which he described as a firework. did not witness or
hear anything else related to the shooting incident.
was a Helper in the kitchen for China King Restaurant. On July 30, 2013,
started work at 0900 hours, and he was putting food in the refrigerator when the incident
occurred. did not witness or hear anything related to the shooting incident.
On July 31, 2013, at approximately 1056 hours, SAPD Detective NGUYEN and I
conducted a canvass interview of a witness in the immediate area of the incident.

Estrellas Mexican Restaurant, 650 South Harbor Boulevard, Santa Ana, CA 92704
was a Waitress at Estrellas Mexican Restaurant. On July 30, 2013,
worked at Estrellas Mexican Restaurant between 1000 hours and 1600 hours. At approximately
1530 hours, observed police officers outside the business. did not witness or hear
anything related to the shooting incident.
