CONKLIN Approved By: Date of Report: 08/07/13 Date: 08/09/2013 Page 1 of 4 CASE NAME: ARELLANO, HANS KEVIN CLASSIFICATION: OFFICER INVOLVED SHOOTING-(FATAL) INTERVIEW OF: PRESENT: CLINT ACHZIGER, DETECTIVE SANTA ANA POLICE DEPARTMENT 60 CIVIC CENTER PLAZA SANTA ANA, CA DATE AND TIME: JULY 30, 2013 1741-1814 HOURS LOCATION: SANTA ANA POLICE DEPARTMENT 60 CIVIC CENTER PLAZA SANTA ANA, CA On the above date and time, Santa Ana Police Department (SAPD) Detective CLINT ACHZIGER and I conducted an audio digital recorded interview of in reference to the officer involved shooting of HANS KEVIN ARELLANO. The following is a summary of the interview: On Tuesday, July 30, 2013, at approximately 1500 hours, arrived at Jugo’s La Tropicana restaurant, 622 South Harbor Boulevard Santa Ana, to purchase a juice beverage. drove to the location alone, and parked her silver, 2010, Honda Accord, facing south; in front of the restaurants glass entrance doors. CONKLIN Approved By: Date of Report: 08/07/13 Date: 08/09/2013 Page 2 of 4 entered the location and ordered a juice beverage from the lone female employee. Initially there were a couple other patrons in the restaurant, but they left soon after ’s arrival. received her juice and sat down facing east, at the second table, west of the entrance door. telephoned her boyfriend; , using her cellular telephone. As was on her cellular telephone speaking with , a male subject, later identified as HANS KEVIN ARELLANO, ran into the restaurant out of breath. described ARELLANO as a male Hispanic, late 20’s to early 30’s, with short black or dark brown hair, unknown on facial hair, wearing a long white un-tucked short sleeve tee shirt, jean pants, and no hat. further described ARELLANO as looking like a “looser,” “up to no good” “a little scruffy” and “a wanna be gangster” or “thug.” She did not remember him having anything in his hands. As ARELLANO entered the restaurant, he looked around, smiled at , turned east, then stood facing north in front of a “juke box” acting as if he was trying to select a song. Approximately a minute afterwards, a female police officer, later identified as SAPD Officer JESSICA GUIDRY, arrived in a police vehicle, and parked, facing west, to the rear of ’s vehicle. GUIDRY exited her vehicle, stood in front of the open driver’s door, withdrew her handgun and pointed it at ARELLANO, with a two handed grip. GUIDRY was on the driver’s side of ’s vehicle at that time. GUIDRY yelled commands at ARELLANO, similar to, “Put your hands up, come out with your hands up,” and other commands that were inaudible to . GUIDRY moved from the asphalt parking lot up onto the sidewalk, in front of the restaurant entrance door. ARELLANO moved away from the juke box, toward the front S.A. 13-017 Investigator: T. As ARELLANO moved toward the door, he initially put both of his hands up, shoulder height, with his palms facing out. Then he put both hands down toward his front pant pockets and started to “fidget” with the outside of his pant pockets. ARELLANO then put both of his hands up again, shoulder height, with his palms facing out, then back down to the outside of his front pant pockets, fidgeting with them, as he exited the restaurant, approaching GUIDRY. ARELLANO was moving his hands, “really fast,” laughing, smiling and didn’t appear to be taking it serious. thought he was being a “smart ass.” After ARELLANO exited the restaurant, he stepped toward GUIDRY “real fast,” “lunged” at her in a “what’s up type lunge,” at which time heard a loud bang. had looked away just prior to the loud bang and did not actually see GUIDRY fire her weapon. told us that ARELLANO must have “frightened her or caught her off guard,” referring to GUIDRY. speculated that ARELLANO was trying to intimidate GUIDRY. Later in the interview, said GUIDRY was on the parking lot asphalt when she fired her weapon. After the loud bang, looked back toward ARELLANO, saw him grab his chest, look at her, and fall to the sidewalk. Other police officers arrived and and the female employee then ran into the kitchen. did not see any weapons in ARELLANO’s hands during the incident. She estimated the interaction between GUIDRY and ARELLANO lasted approximately a minute and a half. said she was on her cellular telephone, talking to throughout the incident and he should have heard the gunshot. CONKLIN Approved By: Date of Report: 08/07/13 Date: 08/09/2013 Page 4 of 4 During the interview, referred to an aerial photograph of the location, which I provided to her. drew a red vehicle icon on the photograph denoting the approximate location where GUIDRY parked her vehicle prior to exiting it. also referred to a handwritten sketch of the location, sketched and provided by Detective ACHZIGER. drew a red “X” denoting the approximate location she was sitting during the shooting, a red “S” denoting the approximate location ARELLANO was initially standing in front of the “juke box,” a red “SS” denoting the approximate location ARELLANO was when he exited the restaurant, and a red “P” denoting the approximate location GUIDRY was standing when she was initially giving her commands. initialed and dated both the aerial photograph and sketch, copies of which are attached to this report. Approximately ten minutes after concluding the interview, Detective ACHZIGER informed me he had a follow up question for . At approximately 1824 hours, we re-contacted in one of the SAPD conference rooms as she was waiting for her boyfriend, , to pick her up. ACHZIGER asked the following in part: If she was the female officer, and ARELLANO had made that “lurching movement” toward her, would she feel that ARELLANO was going to harm her? responded, “No.” ACHZIGER asked , if she would have feared for her safety, and responded, “No.” However, in the initial interview, when I asked if ARELLANO’s actions had frightened her, she responded, “a little bit, yes.” The interview was concluded at 1825 hours.
