I was driving a marked black and white SAPD patrol car and wearing full SAPD uniform with distinct patches, badge and duty belt. I arrived on scene with Officer Bell and observed dozens of people on the front lawn, driveway and sidewalk in front of the house. There were numerous separate fights occurring. I could see many intoxicated subjects and beer cans strewn across the front lawn. We were approached by a female who told us a female inside of the house was having a seizure. At this point, another large disturbance could be heard inside the house. I told the female we would not go inside, for our safety, if there was a fight inside. The female said there was not a fight and only five or six people were inside. Officer Bell and I entered the house and I saw a group of people on the ground. I got closer and a male, later identified as Angel Viliebre (wearing a white t-shirt with ³Champion´written all over it), came towards me from the kitchen area. He began getting aggressive yelling at me to do something to help the female. There were two subjects fighting right next to the female having a seizure. There were also approximately three more people around her arguing, screaming, pushing and shoving each other. Additionally, there were more people fighting on the couch in the same room. Officer Bell and I could not get to the female having a seizure. I was able to see her on the ground shaking uncontrollably consistent with a seizure. I was telling people to get off of her but nobody would get up and move. Viliebre became more aggressive and began yelling at me to help. He came at me aggressively and told him to back up. He continued coming at me and I was concerned for my safety. Viliebre exhibited signs of intoxication, was screaming, puffing out his chest and clenching his fists. Viliebre raised his arms and reached out to push me. I blocked his arms and pushed him back as he swatted at my arms, causing the blood that was on his hands to get on my arms and hands. Multiple subjects, visibly intoxicated, began yelling at Officer Bell and I. I told Officer Bell we should exit the house for our safety due to the large number of people inside compared to just the two of us. We ZDONHG RXW DQG ZDONHG WR WKH VWUHHW At this point, I requested additional Officers due to the rowdy, violent, unruly crowd. Viliebre came back towards us and began yelling that we were not doing anything. It was also at this point I realized my body worn camera was not activated, so I immediately activated it. I told him we were waiting for paramedics and he continued demanding we enter the house for the female. Other friends or family tried to calm him down but he would push them away or tell WKHP QR I observed the fire truck arriving on scene. As OCFA began walking to the door, Officer Bell and I went towards the front door to ensure the firefighters had a safe way to access the patient. While standing in front of the door, I observed multiple males on the sidewalk yelling at the firefighters to hurry. They were visibly intoxicated and DJJUHVVLYH WRZDUGV 2&)$ SHUVRQQHO , ZDONHG RYHU WR WKH PDOHV DQG WROG WKHP QRW WR WRXFK DQ\ RI WKH ILUHILJKWHUV Once all OCFA personnel made it to the house, I walked in behind them. At this point, there were still people inside the house fighting and screaming, which kept the firefighters from getting to her. As people were fighting, I was telling them to leave towards to the front door. It should be noted, the front entry way of the home was very small and close- quarters which limited my movement. There were also conventional and unconventional weapons inside the home. As I was approaching the front door, an unknown male approached me from behind and pushed me while yelling ³move´ and then an obscenity in Spanish. I turned, grabbed him to defend myself from further attack, and pushed him into the front door. A second male, later identified as Candido Ocampo (wearing a burgundy polo shirt), came at me, grabbed me and tried pushing me backwards. This kept me from taking the unknown male into custody. Due to being outnumbered, the obvious sign of intoxication and the physical violence (grabbing and pushing) directed at me, I punched Ocampo one time in the mouth. My strike to Ocampo was effective and temporarily got him off of me. After punching Ocampo, a separate male, later identified as Hugo Cervantes approached me from my right side. Cervantes began grabbing me and pushing me back towards the wall. It should be noted, my body worn camera had fallen off my chest during the altercation. It landed camera side up and caught Cervantes assaulting me. Due to the continued assault on me, I punched Cervantes in the face and pushed him out of the house. At that point, additional officers arrived and grabbed Cervantes, taking him into custody. See Officer Babinski¶s supplemental report for further details. I was now standing outside the front door when Viliebre approached me while yelling what I heard, ³Now you wanna throw paws?´This led me to believe he was referencing fighting or throwing punches. Viliebre continued aggressively coming at me so I used my hands to push him away from me in order to wait for additional officers to assist with taking him into custody for the initial assault on me the first time we went in the house. After ordering Viliebre to stay back, he again came at me aggressively with clenched fists and a puffed out chest while yelling obscenities. Due to Viliebre¶s aggressive conduct, intoxicated state, being significantly larger and stronger than me, pre-assaultive indicators, and immediacy of the threat, I punched Viliebre one time on the right side of his face to defend myself from another physical assault. The punch was effective and Viliebre fell backwards onto the ground. Santa Ana PD 2019-17989 Report by Roelofs, Gavin 3514 3 of 4 Additional officers arrived on scene and I notified them that Viliebre and Ocampo assaulted me and needed to be taken into custody. I provided them with the clothing description of Viliebre and Ocampo and pointed them out. Due to the large crowd, we waited for additional officers and then Viliebre was taken into custody without further incident. A few moments later, Ocampo was also taken into custody without further incident. OCFA personnel assessed Cervantes, Viliebre and Ocampo for injuries and Viliebre was subsequently taken to the hospital. CSI arrived and photographed injuries on Viliebre, Ocampo and Cervantes. CSI also photographed my injury; laceration and swelling on the third knuckle of my right hand. Cervantes, Veliebre and Ocampo were later transported to Santa Ana Jail and booked for PC 243(b) and PC 69. I request this report be forwarded to the District Attorney¶s office for review.
