On 7/28/19 at 0041 hours I was working uniform patrol in a marked black and white police car. I was dispatched to
1234 S. Hickory St. in reference officers who needed assistance with a large fight. While en route officers at the
scene advised via radio that officers had been physically attacked and several subjects were still fighting.
I responded at Sgt. Sanchez¶request for an officer to respond and transport an arrestee (Hugo Cervantes) to the
SADF.
Cervantes was placed in the backseat of my patrol car and bucked in. I could smell the strong odor of an alcoholic
beverage coming from Cervantes¶breath and person. I transported Cervantes to SADF and walked him inside of the
jail with the assistance of Sgt. Sanchez.
Cervantes was in one of the jail chairs within the processing area. There were several officers and correctional
officers present. Cervantes called to me and asked me to smack his ear because he had pain possibly water in it. I
asked him to clarify what he was asking and he said that his ear was hurting because of water inside of it. I asked
which ear was bugging him and he motioned with his head that it was his left ear.
Because I was a swimmer I know how painful and discomforting it was to have water in my ear so I decided to help
Cervantes with his request. When I had water in my ears I would strike my palm against my ear to get the water out.
Because Cervantes was now being cooperative and I decided to assist him with his request.
I used my open left hand and from a distance of about six inches I struck him one on his left ear to aid in removing the
water from inside. Cervantes replied, ³Chill´and I responded that if he did not want my help next time to not ask for
help.
I did not use force to control Cervantes or overcome his resistance or gain compliance. I agreed to assist Cervantes
with his request after he asked me twice to ³smack´his ear to help him with his ear discomfort as a result of water
inside of it. My body worn camera was on the entire time during this incident.
I did advise Sgt. Sanchez of this incident because Cervantes was complaining to me that the smack was a bit hard.
