B~U~~N The Vvarkforce Investment Act ~v111A} requires the Santa Ana v~larkfarce ] nvestr~ent Board X1111] B} establish ~ one-stop delivery system, ~vhose objective is to provide ~rorkforce development services for Local adults, dislocated ~uarkers, youth and employers, The one-stop delivery system is a net~rorl~ of 114I]A-mandated and optional partners uuho are responsible for providing services, as applicable, for training and employr~er~t opportunities authorized by the Act. The ity of Santa Ana currently operates the one-atop enter+ The Memarandur~ of ~lnderstanding ~I~I~U~ provides for collaboration by all of the one-stop _ partners and creates seamless system of service delivery designed to enhance access to the programs' services and improve long-term er~ployrr~ent outcomes far the individuals receiving services Exhibit 1}, The M~ contains the provisions required by the 11111A, vuhich includes services to be provided through the one-stop delivery system; the fundin of these services and g operating costs of the system; and the methods for referring individuals beteen the one~stop operators and partners. Ana. tenter}. ~U~~: The Santa, Ana ~RI~ tenter, through its central location at the Santa Ana Regional Transportation tenter, 1 L~. The methods andlor resources ut~llzed nay include some ar all of the following: cross-training of staff, in-house staff, electronic case management systems, ca-enrollments, appointments, e~m.ail and phone call, 7. ~NFIDE~T~A.L~T~; The ~ agrees that when any individual applies for or receives services from and the partner agency thrQUgh the ~ne~top tenter, all infor~riatiQn regarding such application for or receipt of services shall be confidential inforn~atior~ subject to the provisions of 4 MFR b1.3S. The parties agree to honor the confidentialit~r provisions as described in the local ~ plan, including modifications thereto, and incorporated into this 1VI0 by reference, Exchanged information shall remain private and canf~dential in accordance with the s most restrictive cor~f~dentiality requirements of any of the parties collecting, receiving or sharing information. S. RES~I~RE SHAR~~; The parties agree to share resources in accordance with the attached Resource Sharing Agreement. ~t is expressly understood that this I~I~U does nQt constitute a binding financial commitment, but rather an intent to cornn~it specific resources in the future as the parties' allocations and budgets are l~no~vn and the o~.e-stop system evolves. The one-stag system is v~orl~ in progress and its costs and the partners' resource contributions mill not re~nair~ static from month to month or from year to gear. The Resource Sharing Agreement is meant to be reviewed yearl~r and maybe n~odx~.ed as needed by any partner as long as it is identified s revision, and 1t 1s signed and dated bar the agency Administrator. 9. D~S~TES, The parties shall first attempt tv resolve all disputes informally. Any party nay call a meeting of all parties to discuss and resolve disputes. Should informal resolution efforts fail, the dispute shall be referred to the chair of the SIB, mho shall place the dispute upon the agenda of its next regular or special meeting of the Board's executive committee. The Executive omnlittee shall atterr~pt to mediate and resolve the dispute. Finally, if the Executive Qittee's resolution efforts fail, any party nay file a grievance ~n accordance vr~th the state of llfornlaas ~A grievance procedures. The parties agree to be bound by the final determination resulting from that procedure. Mere practical, the Santa Ana tenter will list partner agencies an fonns and n~arketxng materials distributed to the public. 14, AC~I~I~?IT~ AU.A.NC~ ADD CERTIFICATIONS: The parties agree to abide by all applicable non-discrimination federal and state laws. The w~B and the one-Stop partners will ensure that policies and procedures established by the ~ and the one-Stop partners are in compliance with the Americans with Dxsabilities Act DADA}. The Santa Aria w~RK tenter will assure its services and premises are accessible to persons with disabilities under the requirements of the Americans with Disabilities Act. - 1~. I~URANCE: The one-Stag Partners agree that their current in force insurance ar self insurance coverage programs shall apply to their operations perfarrned under the - workforce Invetn~ent Act anal at the w~RK enter,lncluding commercial general - liability, property damage liability, business personal property, workers' compensation and erriployee dishanestylcrime coverages. 1G.
