MINUTES RECOMMENDATION: Approve the minutes of the regular meeting of July 13, 2009. B. RECORDING SECRETARY REPORT Pursuant to the Brown Act, the July 13, 2009 Notice for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on July 9, 2009 at 1:12 p.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. * * * END OF CONSENT CALENDAR Planning Commission Minutes July 27, 2009 BUSINESS CALENDAR C. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) No disclosures were made. PROCEDURAL RULES PUBLIC HEARINGS 1. CONDITIONAL USE PERMIT NO.2006-20 AND VARIANCE NO. 2006-13 Filed by Caribou Industries to allow a parking lot in the Midtown Specific Plan (SP3) zoning district and to reduce the required landscaped setbacks and parking lot landscaping at 202 East Seventeenth Street. PUBLISHED IN THE ORANGE COUNTY REPORTER: July 17, 2009 PUBLICLY NOTICED: July 17, 2009 RECOMMENDATION: 1. Adopt a resolution approving Conditional Use Permit No. 2006-20 as conditioned to allow a parking lot. 2. Adopt a resolution approving Variance No. 2006-13 (a) as conditioned to allow a reduction in landscaped setbacks. 3. Adopt a resolution approving Variance No. 2006-13 (b) as conditioned to allow a reduction in parking lot landscaping. Principal Planner Vince Fregoso presented the staff report and recommendation. No written communications were received. The public hearing was opened. Julie Stroud expressed concerns with the prior maintenance of the site and recommended landscape enhancements such as, improved irrigation, repairing curbs and installing root guards for the trees. Also, recommended removal of the existing "Liquidamber" tree and the Yucca plants. The public hearing was closed. Commission discussion ensued regarding the site's location as a gateway entrance to French Park and French Court, the submittal of an enhanced landscape plan for the site, correction to Section 2 on the resolution (change address from 3531 South Fairview Street) and obtaining the construction timeline from the developer. MOTION: Continue the public hearing to August 24, 2009, at which time the developer will submit a landscape plan to the Commission for review and approval; staff to correct address on Section 2 of the resolution (page 4 of 9). Planning Commission Minutes 2 July 27, 2009 STAFF AND COMMISSION COMMENTS 1 3. Staff Comments Chief Assistant City Attorney Ben Kaufman announced the opening of the California Court of Appeals, Fourth Appellate District at 601 West Santa Ana Boulevard. Principal Planner Fregoso announced that Karen Haluza's absence was due to bereavement for her mother, Carolyn Wiseman. 4. Planning Commission Comments Commissioner Mill commented on an article regarding the banning of vendor trucks within the Renaissance Specific Plan and requested an update from staff. Vice Chairman Alderete inquired about the state budget impact on projects and requested a report back to the commission. 5. Excuse of Absences Commissioner Yrarrazaval moved to excuse the absences of Commissioners Betancourt and Leo. The motion was seconded by Commissioner Turner and approved by the Commission by a vote of 5:0. 6.
