HomeMy WebLinkAbout2009-08• RESOLUTION NO. 2009-08 KO - 5/4/09 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING NEIGHBORHOOD PROJECT REVIEW NO. 2009-01 TO ALLOW THE CONSTRUCTION OF A 918 SQUARE-FOOT ADDITION, A 114 SQUARE-FOOT FRONT PORCH, DEMOLITION OF THE EXISTING ONE-CAR GARAGE, AND THE CONSTRUCTION OF A NEW 440 SQUARE-FOOT TWO-CAR GARAGE AT 828 SOUTH VAN NESS AVENUE WHICH IS LOCATED WITHIN THE SPECIFIC DEVELOPMENT 40 ZONE (SD-40) (HENINGER PARK) BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: • A. The property owner is requesting approval of Neighborhood Project Review No. 2009-01 to allow the construction of a 918 square-foot addition, a 114 square-foot front porch, and demolish the existing one-car garage, and construct a new 440 square-foot two-car garage at 828 South Van Ness Avenue which is located within the Specific Development 40 Zone (SD-40) (Heninger Park). B. Neighborhood Project Review No. 2009-01 was sent to the Heninger Park Architectural Review Committee for review. The applicant has added notes on the plans indicating that all of the materials will match the materials found on the original single-family residence and has complied with all requirements of the Review Committee with the exception of the recommendation to add slate the on the porch's floor surface. Adding this material will be inconsistent with both the Heninger Park Design Guidelines as well as with the original concrete floor found on the existing porch. C. Santa Ana Municipal Code Section 41-593.5(c) requires the Planning Commission to review all plans within a Specific Development Plan area to ensure that the project is in conformity with the approved Specific Development. • Resolution No. 2009-08 Page 1 of 3 D. On May 1, 2009, the Planning Commission conducted the necessary review pursuant to Santa Ana Municipal Code Section 41-593.5(c). E. After considering all of the evidence submitted, the Planning Commission finds and determines that Neighborhood Project Review No. 2009-01 is consistent with both the Heninger Park Design Guidelines and the Citywide Design Guidelines in regards to architectural style and method of operation. F. In accordance with the California Environmental Quality Act, the proposed project is exempt from further review pursuant to Section 15301, Class 1 and Section 15303, Class 3. This Class 1 exemption allows for the demolition and removal of individual small structures, including garages as well as addition to existing structures not resulting in an increase of more than 10,000 square feet. In addition, this Class 3 exemption allows for the construction of new accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences. Categorical Exemption Environmental Review No. 09-52 will be filed for this project. Section 2. The Planning Commission hereby approves Neighborhood • Project Review No. 2009-01. This decision is based upon, but is not limited to: the Request for Planning Commission Action dated May 11, 2009 and exhibits attached thereto, and the public testimony, all of which are incorporated herein by this reference.
