Separate actions show the actual vote. Items without votes are adopted as part of the consent Motion. A. MINUTES RECOMMENDED MOTION: Approve the minutes of the regular meeting of September 13, 2010. B. CONDITIONAL USE PERMIT N0.2009-22 Filed by Maria Diaz, to allow a Type 41 ABC license (on-premise sale of beer and wine for bona fide eating place) at the Tierra Blanca restaurant at 1502 East First Street in the Community Commercial (C1) zoning district. RECOMMENDED MOTION: Confirm the Zoning Administrator's action approving Conditional Use Permit No. 2009-22 as conditioned. Planning Commission Minutes October 11, 2010 Commission discussion ensued with clarification to Police Conditions No. 5 and No. 30. Recommendation proposed that items have graffiti removal be stated as one item with the 24-hour removal clause (Police Conditions No. 10 and No. 27). Assistant City Attorney Hodge stated there was no conflict as stated in both items; actually Condition No. 27 was a further clarification of No. 10. MOTION: Confirm the Zoning Administrator's action approving Conditional Use Permit No. 2009-22 as conditioned. MINOR EXCEPTION N0.2010-01 Filed by Randy Dettmer, to allow a wrought iron fence that exceeds the maximum four-feet height allowance at 801 East First Street located in the Corridor (CDR) zoning district (SD84-DCR). RECOMMENDED MOTION: Confirm the Zoning Administrator's action approving Minor Exception No. 2010-01 as conditioned. * * * END OF CONSENT CALENDAR * * * BUSINESS CALENDAR D. EXCUSE OF ABSENCES Commissioner Yrarrazaval made a motion to excuse the absences of Commissioners Acosta, Betancourt, and Turner; motion was seconded by Commissioner Gartner.
