A RESOLUTION OF THE ZONING ADMINISTRATOR OF
THE CITY OF SANTA ANA APPROVING TENTATIVE
PARCEL MAP NO. 2003-06 AS CONDITIONED FOR THE
PROPERTY LOCATED AT 1601-1671 EAST ST. ANDREW
PLACE (COUNTY MAP NO. 2002-139)
BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Zoning Administrator of the City of Santa Ana hereby finds,
determines and declares as follows:
A. Tentative parcel map no. 2003-06 came before the Zoning Administrator
of the City of Santa Ana for a public hearing on October 15, 2003.

B. The Zoning Administrator determines that the following findings have been
established:
1. The proposed project, as conditioned, and its design and
improvements are consistent with the Low Density Residential land
use designation of the General Plan and are otherwise consistent
with all other elements of the General Plan and any applicable
specific plans.
The proposed subdivision is consistent with the Industrial
land use designation and all other elements of the General
Plan. The project also complies with the design and
development standards outlined in Specific Development
Plan No. 69 which has previously been approved by the
Planning Commission.
2. The proposed project, as conditioned, conforms to all applicable
requirements of the zoning and subdivision codes as well as other
applicable City ordinances.

The proposed project, as conditioned, conforms to the
provisions of the zoning code with respect to landscaping,
setbacks, parking, lot size and frontage. No variances are
required for the project. Covenants, Conditions and
Restrictions (CC&R's) have been approved by the City and
have been recorded for the project.

3. The project site is physically suitable for the type and density of the
proposed project.
The proposed site is physically suitable for the industrial
development proposed and has been approved by the
Planning Commission without the need to vary from the
City's minimum development standards. Access to the site
is from St. Andrew Place to the south and from Lyon Street
to the east. There are no physical constraints on the site
that would preclude the development of the project as
proposed. The proposed Floor Area Ratio (FAR) within the
Planned Development is 0.43 percent, which is below the
0.45 percent permitted under the Industrial General Plan
land use designation.

4. The design and improvements of the proposed project will not
cause substantial environmental damage or substantially and
avoidably injure fish and wildlife or their habitat.
An Initial Study and Negative Declaration was prepared
pursuant to the California Environment Quality Act (CEQA).
The project site is located in an urbanized area. There are
no known fish or wildlife populations, wetlands or unusual
flora or fauna on or around the project site. Therefore, the
proposed subdivision will not cause any substantial
environmental damage or substantially and avoidably injure
fish and wildlife or their habitat.
5. The design or improvements of the proposed project will not cause
serious public health problems.
The proposed subdivision will not have any detrimental
effects upon the general public. Each property will meet the
City's requirements pertaining to sewer, water utilities and
infrastructure improvements as conditioned in Development
Project Review No. 2002-49.

6. The design or improvements of the proposed project will not conflict
with easements necessary for public access through or use of the
property within the proposed project.
The design or improvements of the proposed project will not

public access will be provided from Lyon Street and St.
Andrew Place. These are existing streets that were
constructed according to City specifications.

• Section 2. The Zoning Administrator has reviewed and considered the
information contained in the initial study and the negative declaration prepared with
respect to this Project. As a result of this consideration and the evidence presented at the
hearing on this matter, the Zoning Administrator has determined that, as required pursuant
to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a
Negative Declaration adequately addresses the expected environmental impacts of this
Project. On the basis of this review, the Zoning Administrator finds that there is no
evidence from which it can be fairly argued that the Project will have a significant adverse
effect on the environment. The Zoning Administrator hereby certifies and approves the
negative declaration and directs that the Notice of Determination be prepared and filed
with the County Clerk of the County of Orange in the manner required by law.
Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the
Zoning Administrator has determined that, after considering the record as a whole, there is
no evidence that the proposed project will have the potential for any adverse effect on
wildlife resources or the ecological habitat upon which wildlife resources depend. The
proposed project exists in an urban environment characterized by paved concrete,
roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and
Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game
Department filing fees is not required in conjunction with this project.
Section 3. The Zoning Administrator of the City of Santa Ana after conducting
• the public hearing hereby approves Tentative Parcel Map No. 2003-06 as conditioned in
Exhibit "A" attached hereto and incorporated herein.

Conditions of Approval for Tentative Parcel Map No. 2003-05

Tentative Parcel Map No. 2003-06 (County Map No. 2002-139) is approved subject to
compliance, to the reasonable satisfaction of the Planning Manager, with all applicable
sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform
Fire Code, the Uniform Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed below riot to
exercising the rights conferred by this tentative parcel map.
The applicant must remain in compliance with all conditions listed below throughout the
life of the parcel map. Failure to comply with each and every condition may result in the
revocation of the parcel map.
A. PLANNING DIVISION
1. Comply with Development Review Committee comments dated July 31,
2002 for Site Plan Review DP No. 02-49.
2. Project landscaping, including irrigation systems, shall be maintained as
one common area under control of the Association for the integrated
development. Should any one parcel become vacant, it would be the
responsibility of the association to ensure maintenance of that parcel.
• 3. The project shall continue to function as an integrated development. No
fences will be permitted across drive aisles for the purpose of creating
yard areas for individual parcels.
4. All common area utilities, including but not limited to lighting, water and
irrigation shall be controlled by separate utility meters. Building mounted
wall pacts and lighting necessary to meet City common area lighting
requirements shall have a separate utility meter controlled by the
Association. (Modified by the Zoning Administrator on October 15,
2003).
5. All pot holes, raised paving and broken curbs within the boundaries of the
map shall be repaired and parking areas slurry coated and restriped to
City standards as part of a normal maintenance program.
6. Conditions Covenants and Restrictions (CC&R's) must be approved by
the City prior to final map approval. The CC&R's must address common
area maintenance, drainage, architecture, parking, circulation, etc., and
shall be recorded prior to final map approval.
7. Two copies of the recorded final parcel map and City approved CC&R's
shall be submitted each to the Planning Division, Building Division and
Public Works Agency within 10 days of recordation.
• 8. The tentative map, final map and all improvements required to be made or
installed by the subdivider shall be in accordance with the design

• standards and specifications of the City of Santa Ana and at the
requirements of the State Subdivision Map Act.
9. All development within the area of the map is subject to development and
other applicable fees including permit fees in effect at the time of permit
issuance.
10. All development within the area of the map is subject to all design and
development standards in effect at the time of building permit issuance.
11. Project landscaping is to be maintained to include the minimum levels of
plant materials installed at the time of final map approval.
B. Building Department
1. The Building Official of the City of Santa Ana shall approve any modification
to the CC&R's that affects any development within the boundaries of the
Map.
