HomeMy WebLinkAbout2003-141 RESOLUTION NO. 2003-14 Iss/04/10/03 A RESOLUTION OF THE PLANNING COMISSION OF THE CITY OF SANTA ANA DENYING APPEAL OF PLANNING MANAGER'S DECISION NO. 2003-02 TO DENY ADDITION WITH BATHROOM TO AN EXISTING DETACHED GARAGE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. The Applicant proposes an addition of a 500 square foot workshop with a full bathroom and laundry facility to an existing detached two-car garage at 2139 North Greenleaf Street. B. The General Plan land use designation for the property and the neighborhood is Low Density Residential (LR-7), with a corresponding zoning designation of Single-Family Residence (R1), which allows one single-family dwelling per lot. C. The Planning Manager denied the addition pursuant to Santa Ana Municipal Code (SAMC) section 41-619(a), which prohibits additions to residential buildings if the addition would promote the ability of the owner or occupant of the building to create an illegal additional dwelling unit in the building. D. The Planning Commission, after considering all of the evidence submitted, finds and determines that the proposed addition is conducive to the creation of a second dwelling in violation of SAMC section 41-619 (a). E. In accordance with the California Environmental Quality Act, the proposed project is exempt from further review. As such, Categorical Exemption Environmental Review No. 2003-56 will be filed for this project. • Section 2. The Planning Commission hereby denies Appeal of the Planning Manager's Decision No. 2003-02.
