HomeMy WebLinkAbout2003-01• RESOLUTION NO.2003-01 kdo/1 /9/03 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2002-24 TO ALLOW A NEW HALL AT AN EXISTING CHURCH IN THE SINGLE-FAMILY DWELLING/PLANNED RESIDENTIAL DEVELOPMENT (R1-PRD) DISTRICT AT 2530 WEST WARNER AVENUE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Conditional Use Permit No. 2002-24 came before the Planning Commission of the City of Santa Ana for a duly noticed public hearing on January 13, 2003. . B. Conditional Use Permit No. 2002-24 has been filed with the City of Santa Ana seeking to allow an addition to a church facility at 2530 West Warner Avenue. The addition involves the construction of a lunch hall and lobby area to the existing temple building. A conditional use permit is required per Section 41-232.5 and Section 41-590 of the Santa Ana Municipal Code for a church and accessory church buildings in the Single-Family Residence/Planned Residential Development (R1-PRD) district. C. Santa Ana Municipal Code Section 41-638 authorizes the Planning Commission to grant a conditional use permit upon making certain findings. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or community? The proposed lunch hall will contribute to the well being of the surrounding neighborhood by mitigating any future noise impacts with the temple use. Additionally, conditions of approval have been added to the proposal to mitigate any traffic impacts to the surrounding area, as the uses will be non-concurrent and should not generate additional vehicular • traffic. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The lunch hall will improve the existing facility and, thus, will not be detrimental to the health, safety or general welfare of persons residing or working in the vicinity or injurious to property or improvements in the area. The design, orientation and purpose of the building are such that it will provide an improvement to the site. Moreover, conditions are imposed to mitigate any potential impacts to those in the vicinity. 3. Will the proposed use adversely affect the present economic stability or future economic development of properties in the surrounding area? The existing church has contributed to the present economic stability and economic development in the area. The proposed addition should not adversely affect the economic stability or future development in the area. 4. Will the proposed use comply with the regulations and conditions • specified in Chapter 41 of the Santa Ana Municipal Code for such use? As conditioned, the proposed project will be in compliance with all applicable regulations and conditions imposed on church uses. 5. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed use will not adversely affect the General Plan. Churches are permitted within the District Center (LMR-11) General Plan designation and the Single-Family Residence/Planned Residential Development (R1-PRD) district. Additionally, the use as conditioned is in compliance with the regulations identified in the zoning code. The proposed expansion will not affect the General Plan as it is an expansion of an existing use Section 2. The Planning Commission has reviewed and considered the information contained in the initial study and the Mitigated Negative Declaration and Mitigation Monitoring Program prepared with respect to this Project. The Planning Commission has, as a result of its consideration and the evidence presented at the . hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Mitigated Negative Resolution No. 2003-01 Page 2 of 3 Declaration and Mitigation Monitoring Program adequately addresses the expected environmental impacts of this Project. On the basis of this review, the Planning Commission finds that there is no evidence from which it can be fairly argued that the Project will have a significant adverse effect on the environment. The Planning Commission hereby certifies and approves the Mitigated Negative Declaration and Mitigation Monitoring Program and directs that the Notice of Determination be prepared and filed with the County Clerk of the County of Orange in the manner required by law. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the Planning Commission has determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Game Code § 711.2 and Title XIV, CCR § 753.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. • Section 3. The Planning Commission after conducting the public hearing hereby approves Conditional Use Permit No.2002-24 as conditioned in Exhibit "A" attached hereto and incorporated herein. Date: ~ P nning fission Secretary City of Sa a Ana • • Resolution No. 2003-01 Page 4 of 3 Conditions for Approval for Conditional Use Permit No. 2002-24 Should Conditional Use Permit No. 2002-24 be approved, the project shall comply with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. In addition, it shall meet the following conditions: The applicant must comply in full with each and every condition listed below rip or to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. A. Planning Division 1. Any amendment to this conditional use permit must be submitted to the Planning Division and Police Department for review. 2. Provide a minimum of 105 parking spaces. The minimum parking stall size is 8-1/2 feet by 18 feet. All stalls shall be double striped and shall not encroach into required landscape areas. 3. There shall be no simultaneous use of both the sanctuary temple building and the lunch hall. A minimum of one-half hour time separation shall be required between the unrelated uses of the two areas. 4. The lunch hall shall be utilized exclusively for church activities and shall not be rented or leased to other organizations. 5. Final elevations, construction materials and colors shall be subject to final Planning Division Approval. 6. Exterior lighting in compliance with Police Department security standards. 7. There shall be no music, chanting or religious services conducted outside. Any background music or noise shall not be audible beyond 20 feet from the exterior of the premises in any direction. 8. The project shall remain in compliance with Site Plan Review (DP No. 02- 07). B. Police Department 1. The existing building and parking lot (that will be utilized by the Center) must conform to the provisions of Chapter 8, Article II, Division 3 of the Santa Ana Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices and addressing be upgraded to current code standards. i Lighting standards cannot be located in required landscape planters.
