A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA APPROVING SITE PLAN
REVIEW NO. 2004-02 AND CONDITIONAL USE PERMIT
NO. 2004-09 AS CONDITIONED FOR CONSTRUCTION
OF A PARKING STRUCTURE FOR THE PROPERTY
LOCATED AT 1500 AUTO MALL DRIVE WHICH IS WITHIN
SPECIFIC DEVELOPMENT NO. 60 (SD-60)
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby finds,
determines and declares as follows:
A. The Applicant is requesting approval to construct a sales, service and
office area to their existing dealership. A conditional use permit is also
requested to construct afive-level, six tier parking structure for the
property located at 1500 Auto mall Drive which is within in the Specific
Development No. 60 (SD-60) zoning district.

B. Site Plan Review No. 2004-02 and Conditional Use Permit No. 2004-09
came before the Planning Commission of the City of Santa Ana on May 10,
2004.
C. Section 41-593.5(c) of the Santa Ana Municipal Code requires a review by
the Planning Commission of all plans within a specific development plan
area to ensure the project is in conformity with the Specific Plan.
The project is in compliance with all applicable development
standards outlined within the Specific Development Plan (SD-60).
2. The project exceeds the landscape requirements for SD-60.
D. The applicant is requesting approval of Conditional Use Permit No. 2004-
09 to construct afive-level parking structure.
1. SD-60 allows parking structures not exceeding five levels and not
higher than 60 feet subject to the issuance of a conditional use
permit.
2. Santa Ana Municipal Code Section 41-638 authorizes the Planning
Commission to grant a conditional use permit upon making certain
findings.

i. Will the proposed use provide a service or facility which will
• contribute to the general well being of the neighborhood or
community?
The proposed parking structure will provide a benefit
to the community by allowing an existing dealership
within the Santa Ana Auto Mall to increase the
number of vehicles that they can store on their site.
This increased inventory will allow the dealership to
sell more vehicles, which in turn will provide additional
sales tax revenue to the City. This additional sales
tax revenue will contribute to the general well being of
the community.
ii. Will the proposed use under the circumstances of the
particular case be detrimental to the health, safety, or
general welfare of persons residing or working in the
vicinity?
The parking structure is a conditionally permitted use
within Specific Development No. 60 and will be used
primarily to store vehicles that will ultimately be sold
on the project site. The storage of vehicles to
increase dealer inventory is an ancillary component to
the auto dealership use, which has been operating
• within the Auto Mall for close to 20 years. The
purpose of the Auto Mall is to sell vehicles, and the
purpose of the parking structure is to increase the
availability of vehicles to sell. Therefore, the parking
structure will not be detrimental to the health, safety
or general welfare of persons residing or working in
the area.
iii. Will the proposed use adversely affect the present economic
stability or future economic development of properties
surrounding the area?
The project will help the stability and future economic
development of the area by allowing an existing
dealership within the City to expand and by providing
a secure place where the dealership can store
additional cars to be sold. Increased inventory should
draw more customers to the site, which will result in
additional customers visiting other dealerships within
the Auto Mall. These additional customers will aid the
economic stability and future economic development
of businesses in the surrounding area.
• iv. Will the proposed use comply with the regulations and
conditions specified in Chapter 41 for such use?

The project will comply with all applicable city codes
and standards pertaining to the parking structure use
as well as the standards outlined in Specific
Development No. 60, which governs development
within the Auto Mall.
v. Will the proposed use adversely affect the General Plan or
any specific plan of the City?
There are no amendments to the General Plan
proposed as part of this project and therefore the
operation of the parking structure on the project site
will have no affect on the City's General Plan.
Parking structures are permitted within the Industrial
(IND) General Plan designation and are allowed with
a conditional use permit in the Specific Development
No. 60 (SD-60) zoning district.
E. In accordance with the California Environmental Quality Act, the
recommended action is exempt from further review. Categorical
Exemption Environmental Review No. 2003-111 will be filed for this
project.
Section 2. The Planning Commission of the City of Santa Ana hereby
approves Site Plan Review No. 2004-02 and approves Conditional Use Permit No. 2004-
09 as conditioned in Exhibit "A" attached hereto and incorporated herein.

• Conditional Use Permit No. 2004-09 is a roved sub'ect to com lian to th
pp ~ p ce, a reasonable
satisfaction of the Planning Manager, with all applicable sections of the Santa Ana
Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform
Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed below rip or to
exercising the rights conferred by this conditional use permit.
The applicant must remain in compliance with all conditions listed below throughout the
life of the conditional use permit. Failure to comply with each and every condition may
result in the revocation of the conditional use permit.
A. Planning Division
1. Comply with Development Review Committee comments dated February
24, 2004 for Site Plan Review DP No. 2003-29.
2. Any amendment to this conditional use permit must be submitted to the
Planning Division and Police Department for review. At that time, staff will
determine if administrative relief is available or the conditional use permit
must be amended.
• 3. The eleven existing Queen Palms that exist at the northwest corner of Auto
Mall Drive and Edinger Avenue and the eight existing Queen Palms at the
northeast corner shall remain in place. However, this condition recognizes
that it may become necessary to temporarily remove and relocate these
trees to facilitate construction of the new entry signs, right-turn lanes and
other related improvements shown on the Planting Plan Phasing Plan.
Accordingly, trees to be removed must be boxed and stored at a location
acceptable to the City until such time that the Queen Palms can be
reconfigured in the area where they previously existed to the satisfaction of
the City. If any Queen Palms become unhealthy (as determined by the
City), they shall be replaced in equal numbers and heights.
4. Entry signage and corner landscape improvements on the northwest and
northeast corner of Edinger Avenue and Auto Mall Drive must be
completed as part of Phase II construction.
5. The nine Podocarpus Gracilior trees to be removed at the project entry shall be
replaced with 48-inch box Podocarpus Gracilior trees.
6. Text for the entry signage at the northwest and northeast corner of Edinger
Avenue and Auto Mall Drive shall be proportional and centered on the
• monument signs.

7. A lot line adjustment shall be filed, approved and recorded to consolidate the
project into one project site prior to issuance of building permits for phase II
construction.
B. Police Department
1. All parking structures shall comply with the City of Santa Ana parking structure
design and security guidelines.
