A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF SANTA ANA
APPROVING CONDITIONAL USE PERMIT NO.
2002-26 TO EXCEED 30 PERCENT OFFICE IN
THE LIGHT INDUSTRIAL ZONE AT 3080 SOUTH
HARBOR BLVD.
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby finds,
determines and declares as follows:
A. Conditional Use Permit No. 2002-26 came before the Planning
Commission of the City of Santa Ana for a duly noticed public hearing on
December 9, 2002.
• B. Conditional Use Permit No. 2002-26 has been filed with the City of Santa
Ana seeking to exceed the allowable office square footage within an
industrial building at 3080 South Harbor Boulevard. A conditional use
permit is required per Section 41-472.1 of the Santa Ana Municipal Code
to exceed 30 percent of the gross square footage with office area within
an industrial building.
C. Santa Ana Municipal Code Section 41-638 authorizes the Planning
Commission to grant a conditional use permit upon making certain
findings.
Will the proposed use provide a service or facility which will
contribute to the general well being of the neighborhood or
community?
The project use will provide a combination of office/industrial
space in an established, industrial base area. In addition,
this mortgage company provides a service that will benefit
the surrounding industrial area.
2. Will the proposed use under the circumstances of the particular
case be detrimental to the health, safety or general welfare of
persons residing or working in the vicinity?

• Since the proposed operation will be primarily office, the use
will not introduce any waste products and will have a low
amount of visitors to the site. The site complies with all
development standards, which should enhance and not be
detrimental to persons residing or working in the area.
3. Will the proposed use adversely affect the present economic
stability or future economic development of properties in the
surrounding area?
The mortgage company will occupy a previously vacant shell
building constructed in 2000. Bankers Diversified Mortgage
intends to improve the interior of the building and add
features to accent the exterior of the building for the new
interior office areas. The proposed improvements will add
value to the property and enhance the economic viability of
the area by providing a stable tenant that has served the
community for close to 17 years. This use and the proposed
property improvements should benefit the community and
not adversely affect the present economic stability or future
economic development of properties in the surrounding area.
4. Will the proposed use comply with the regulations and conditions
• specified in Chapter 41 of the Santa Ana Municipal Code for such
use?
The subject property is zoned Light Industrial. The project
and the site will be in compliance with all code regulations
and requirements imposed. The project currently meets or
exceeds all minimum standards specified in Chapter 41 of
the City of Santa Ana zoning ordinance.
5. Will the proposed use adversely affect the General Plan or any
specific plan of the City?
The proposed use will not adversely impact the General Plan
of the City, as this office/industrial use is consistent with the
industrial land use designation. In addition, due to no floor
area expansion, but rather a conversion of existing floor area,
the existing floor area ratio has not been altered.
D. In accordance with the California Environmental Quality Act, the
recommended action is exempt from further review. Categorical
Exemption Environmental Review No. 2002-244 will be filed for this
project.

• Section 2. The Planning Commission after conducting the public hearing hereby
approves Conditional Use Permit No.2002-26 as conditioned in Exhibit "A" attached
hereto and incorporated herein.

• Conditions for Approval for Conditional Use Permit No. 2002-26
Should Conditional Use Permit No. 2002-26 be approved, the project shall comply with all
applicable sections of the Santa Ana Municipal Code, the California Administrative Code,
the Uniform Fire Code, the Uniform Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed below rior to
exercising the rights conferred by this conditional use permit.
The applicant must remain in compliance with all conditions listed below throughout the
life of the conditional use permit. Failure to comply with each and every condition may
result in the revocation of the conditional use permit.
A. Planning Division
Any amendment to this conditional use permit must be submitted to the
Planning Division and Police Department for review.
2. The project shall remain in compliance with Site Plan Review (DP No. 02-
48).
B. Police Department
• 1. Submitted plans must indicate that all structures and parking lots comply
with the provisions of Chapter 8, Article II, Division 3 of the Santa Ana
Municipal Code (Building Security Ordinance). All exterior doors must
have exterior light fixtures providing a minimum maintained 1-foot candle
of light
