WORK STUDY SESSION
E. DISCUSSION OF CONDO CONVERSIONS
Karen Haluza provided the Commissioners with a copy of the Santa Ana Municipal Code
Section 34-337 and Housing Element Policy 2-4.3 which address condominium
conversions.
Mr. Kaufman discussed state law regarding vesting of finals maps for purposes of
condominium conversion. The courts have found that having a final map is not enough
to prove vesting if no units were sold and that the report from the Department of Real
Estate must be kept current each year.
Mr. Trevino provided additional information on policy issues. He discussed the problems
with creation of ownership opportunities coupled with income; and considerations of
rental versus for-sale housing.
Commission discussion ensued regarding the pros and cons with ownership housing,
undesirability of condo conversions that lack amenities, concerns about the ability of
condo conversions to be as well maintained over time as a single owner of an apartment
complex, and the adequacy of the existing laws.
