APPROVAL OF MINUTES RECOMMENDATION: Approve the minutes from the regular meeting of July 12, 2004. B. RECORDING SECRETARY REPORT Pursuant to the Brown Act and the Maddy Act, the July 12, 2004 Agenda for the Regular Meeting was posted on the door of the City Hall Council Chambers at 22 Civic Center Plaza on July 9, 2004 at 9:00 a.m. RECOMMENDATION: Instruct the Commission Secretary to enter posting into the minutes. * * * END OF CONSENT CALENDAR * * * BUSINESS CALENDAR C. COMMISSIONER COMMUNICATION DISCLOSURE (REGARDING AGENDIZED PROJECTS) Commissioners Cribb, Leo, Nalle, De La Torre, Sinclair and Mondo disclosed a conversation with Brandywine. WORK STUDY SESSION D. OVERVIEW OF CONFLICT OF INTEREST AND BROWN ACT Ben Kaufman presented a power point presentation on the Conflict of Interest laws and the Brown Act. Topics of discussion included violations and penalties of the laws as well as the implications of meeting with the applicants. E. OVERVIEW OF LIMITATIONS ON DEDICATIONS, EXACTIONS AND CONDITIONS OF APPROVAL Mr. Kaufman distributed a handout to the Commissioners. Chairman Mondo opened the public hearing. Written communications from Maria Sandoval and Dave Lopez were distributed to the Commissioners. Public in support of the project: Pat McGuigan (provided photos of fence posts to be used on project -galvanized post set in concrete), Gary Schiveley and Leon Saunders. Public opposing the project: Maria Sandoval expressed concern regarding the proposed wood fence (on easterly wall) and would like Brandywine to use block walls throughout the project. Chairman Mondo closed the public hearing. Commission discussion ensued regarding the wood/block wall, the landscaping and conditions of approval to tract map. Mark Whitehead, applicant, addressed the issues raised regarding the landscaping and agreed to increase the size of the trees on private property to 24-inch box trees. Jay Trevino, Planning Manager, reviewed process. • Inquired about the potted trees at the California Apartments. Staff noted that they were on private property. C Chairman Mondo • Commented about locks on portable restrooms at Lillie King Park placed by sports leagues, and requested clarification of city policy regarding locking up facilities or equipment at public parks. • Requested Code Enforcement follow-up on Home Depot outdoor storage at MacArthur and Harbor. Noted that there are sheds, people selling and large outdoor displays; wants rules enforced. • Requested that the Commission's Ad Hoc Committee review whether block walls should be required for new single-family homes, such as those proposed by Brandywine. 8.
