HomeMy WebLinkAbout2002-23• RESOLUTION NO.2002-23 Kdo/08/26/02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 2002-10 TO ALLOW TRAFFIC SCHOOL AT 2100 EAST FOURTH STREET, SUITE 120 BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Santa Ana Municipal Code Section 41-313.5 requires a conditional use permit for trade and professional schools in the Professional district. B. The Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 2001-146 and Conditional Use Permit No. • 2002-10 came before the Planning Commission of the City of Santa Ana for a duly noticed public hearing on August 26, 2002. C. Santa Ana Municipal Code Section 41-638 authorizes the Planning Commission to grant a conditional use permit upon making certain findings. Will the proposed use provide a service or facility that will contribute to the general well being of the neighborhood or the community? The approval of the National Traffic Safety Institute (NTSI) traffic school as conditioned will establish a traffic school facility which will provide necessary training services for the adult community. 2. The proposed use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity. The traffic school as conditioned will not create any detrimental impacts to the persons residing or working in the area, as the classes will be conducted only during the evening hours and on Saturdays. CJ Resolution No. 2002-23 Page 1 of 3 • 3. The proposed use will not adversely affect the present economic stability or future economic development of property in the surrounding area. The proposed traffic school as conditioned will not create any negative or detrimental impacts on the economic viability of the surrounding area. The traffic school programs will be conducted within an existing two-story office building and the proposed use will cater to and support the existing professional office environment. 4. The proposed use will comply with the regulations and conditions specified in this chapter for such use. The proposed traffic school as conditioned is consistent with and will comply with all regulations and conditions specified in the Santa Ana Municipal Code pertaining to such development. 5. The proposed use will not adversely affect the general plan of the city or any specific plan applicable to the area of the proposed use. The proposed traffic school as conditioned will be consistent • with the General Plan and will not have any adverse impacts on the General Plan designation of Professional and Administrative Office (PAO). Section 2. The Planning Commission has reviewed and considered the information contained in the initial study and the negative declaration prepared with respect to this Project. The Planning Commission has, as a result of its consideration and the evidence presented at the hearings on this matter, determined that, as required pursuant to the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 2001-146 adequately addresses the expected environmental impacts of this Project. On the basis of this review, the Planning Commission finds that there is no evidence from which it can be fairly argued that the Project will have a significant adverse effect on the environment. The Planning Commission hereby certifies and approves the Mitigated Negative Declaration and Mitigation Monitoring Program and directs that the Notice of Determination be prepared and filed with the County Clerk of the County of Orange in the manner required by law. Pursuant to Title XIV, California Code of Regulations ("CCR") § 735.5(c)(1), the Planning Commission has determined that, after considering the record as a whole, there is no evidence that the proposed project will have the potential for any adverse effect on wildlife resources or the ecological habitat upon which wildlife resources depend. The • proposed project exists in an urban environment characterized by paved concrete, roadways, surrounding buildings and human activity. Therefore, pursuant to Fish and Resolution No. 2002-23 Page 2 of 3 • Game Code § 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish and Game Department filing fees is not required in conjunction with this project. Section 3. The Planning Commission hereby, approves Conditional Use Permit No. 2002-10 as conditioned in Exhibit "A" attached hereto and incorporated herein. Date: ?~-- ~I Wing Com sion Secretary C" v of Sant na Resolution No. 2002-23 Page 3 of 3 • Conditions for Approval for Conditional Use Permit No. 2002-10 Conditional Use Permit No. 2002-10 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below rior to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of this project. A. Planning Division 1. The project shall remain in compliance with Site Plan Review DP No. 01- 62. 2. Hours of operation for the classroom portion of the proposed project will be limited to the following: Monday through Friday 6:00 p.m. - 9:00 p.m. Saturday 8:00 a.m. - 4:00 p.m. • 3. All existing parking stalls shall be re-striped and dimensioned per Santa Ana Municipal Code (SAMC) Section 41-1303. 4. Existing parking lot lighting must be brought into compliance with the City of Santa Ana Building Security Ordinance. 5. The conditional use permit shall be reviewed at six months, nine months, and one year by the Planning Commission.. (Modified by the Planning Commission on August 26, 2002.) 6.
