HomeMy WebLinkAbout2002-22• RESOLUTION NO.2002-22 Kdo/08/29/02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING MINOR EXCEPTION NO. 2002-05 FOR THE PROPERTY AT 2100 EAST FOURTH STREET, SUITE 120 BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. Minor Exception No 2002-05 came before the Planning Commission of the City of Santa Ana for a public hearing on August 26, 2002. B. Minor Exception No. 2002-05 has been filed with the City of Santa Ana seeking to allow shared parking between uses on the project site located at 2100 East Fourth Street, Suite 120. • C. The Zoning Administrator determines that the following findings, which must be established in order to grant a minor exception from the provisions of the Santa Ana Municipal Code, have been established: That because of special circumstances applicable to the subject property, including size, shape, topography, location, or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. The number of parking spaces provided will be sufficient since the site will be used in a shared manner. The proposed traffic school will operate during off-peak hours, thereby reducing impacts to other uses existing on the project site. 2. That the granting of a variance or minor exception is necessary for the preservation and enjoyment of one or more substantial property rights. The granting of the minor exception will allow the traffic school use to operate in a manner that is consistent with the Professional (P) zoning district. • Resolution No. 2002-22 Page 1 of • 3. That the granting of a variance or minor exception will not be materially detrimental to the public welfare or injurious to surrounding property. The granting of a minor exception will not be materially detrimental to the public welfare or injurious to surrounding property because the traffic school will operate during off-peak hours. Additionally, conditions of approval have been added that will mitigate impacts on surrounding properties. 4. That the granting of a variance or minor exception will not adversely affect the General Plan of the City. The minor exception will not adversely affect the General Plan, as the traffic school will be in conformance with the Professional (P) zoning district development standards and General Plan requirements. D. The Mitigated Negative Declaration and Mitigation Monitoring Program for Environmental Review No. 2001-146 was approved and adopted with the Resolution approving Conditional Use Permit Number 2002-10. Section 2. The Planning Commission of the City of Santa Ana after conducting • the public hearing hereby approves Minor Exception No. 2002-04 as conditioned in Exhibit "A" attached hereto and incorporated herein. Date: o a Wing Co fission Secretary Citv of S a Ana • • Resolution No. 2002-22 Page 3 of 3 • Conditions for Approval for Minor Exception No. 2002-05 Minor Exception No. 2002-05 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code and all other applicable regulations. The applicant must comply in full with each and every condition listed below rip or to exercising the rights conferred by this minor exception. The applicant must remain in compliance with all conditions listed below throughout the life of this project. A. Planning Division 1. The project shall remain in compliance with Site Plan Review DP No. 01- 62. 2. Any amendment to this minor exception must be submitted to the Planning Division for review. At this time, staff will determine if administrative relief is available or the minor exception must be amended. • 3. Hours of operation for the classroom portion of the proposed project will be limited to the following: Monday through Friday 6:00 p.m. - 9:00 p.m. Saturday 8:00 a.m. - 4:00 p.m. 4. All existing parking stalls shall be re-striped and dimensioned per Santa Ana Municipal Code (SAMC) Section 41-1303. 5. Existing parking lot lighting must be brought into compliance with the City of Santa Ana Building Security Ordinance. • Exhibit A
