A RESOLUTION OF THE ZONING ADMINISTRATOR OF
THE CITY OF SANTA ANA APPROVING MINOR
EXCEPTION NO 2002-01 FOR THE PROPERTY AT 416
SOUTH PACIFIC AVENUE
BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA
ANA AS FOLLOWS:
Section 1. The Zoning Administrator of the City of Santa Ana hereby finds,
determines and declares as follows:
A. Minor Exception No. 2002-01 came before the Zoning Administrator of the
City of Santa Ana for a public hearing on April 3, 2002.
B. Minor Exception No. 2002-01 has been filed with the City of Santa Ana
seeking to permit a four and 1/2 foot fence in the front yard for the property
located at 416 South Pacific Avenue.
• C. The Zoning Administrator determines that the following findings, which must
be established in order to grant a minor exception from the provisions of the
Santa Ana Municipal Code, have been established:
That because of special circumstances applicable to the subject
property, including size, shape, topography, location or surroundings,
the strict application of the zoning ordinance is found to deprive the
subject property of privileges not otherwise at variance with the intent
and purpose of the provisions of this chapter.
Due to the close proximity to a heavily traveled intersection
and the associated noise and traffic generated as a result, a
fence slightly above the code requirement is warranted at
this location.
2. That the granting of a variance or minor exception is necessary for
the preservation and enjoyment of one or more substantial property
rights.
The granting of Minor Exception No. 2002-01 will preserve and
secure the rights of the property owner. The existing fence, as
built, can only be reduced to a maximum height of 38 inches
• due to the configuration of existing masonry blocks. In this
instance, the fence will remain closer to compliance with the
Resolution No. 2002-12

• code and not cause undue economic hardship on the property
owner to reduce the height of the as built fence.
3. That the granting of a variance or minor exception will not be
materially detrimental to the public welfare or injurious to surrounding
property.
The fence material is consistent with existing neighborhood
fences. The fence will not be detrimental or injurious to
surrounding properties.
4. That the granting of a variance or minor exception will not adversely
affect the General Plan of the City.
The requested minor exception will not adversely affect the
General Plan, as it does not conflict with the goals and policies
expressed in that document.
D. Categorical Exemption Environmental Review No. 02-125 will be filed for
this project pursuant to the California Environmental Quality Act.
Section 2. The Zoning Administrator of the City of Santa Ana after conducting
the public hearing hereby approves Minor Exception No. 2002-01.
