A RESOLUTION OF THE PLANNING COMISSION OF THE
CITY OF SANTA ANA APPROVING AND ADOPTING THE
MITIGATED NEGATIVE DECLARATION AND MITIGATION
MONITORING PROGRAM FOR ENVIRONMENTAL
REVIEW NO. 01-118, APPROVING A CONDITIONAL USE
PERMIT NO. 01-29 TO ALLOW A HELISTOP, AND
APPROVING SITE PLAN REVIEW NO. 01-12 AT 1505
SOUTH AUTO MALL DRIVE
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission of the City of Santa Ana hereby finds,
determines and declares as follows:
A. The Mitigated Negative Declaration and the Mitigation Monitoring Program
for Environmental Review No. 01-118, Conditional Use Permit No. 2001-
. 32, and Site Plan Review No. 01-12 came before the Planning
Commission of the City of Santa Ana for a public hearing on November
26, 2001.
B. Conditional Use Permit No. 2001-32 has been filed with the City of Santa
Ana seeking to allow a helistop at the Santa Ana Honda Dealership located
at 1505 South Auto Mall Drive, in the City of Santa Ana, as a conditional
use.
C. Santa Ana Municipal Code Section 41-638 authorizes the Planning
Commission to grant a conditional use permit upon making certain
findings.
D. Will the proposed use provide a service or facility, which will contribute to
the general welfare of the neighborhood or community?
The helistop will provide a service to the owner of the Santa Ana
Honda Auto dealership by providing an additional means of ingress
and egress to the facility.
E. Will the proposed use under the circumstances of the particular case be
detrimental to the health, safety or general welfare of the persons residing
or working in the vicinity?

• The proposed helistop is not expected to have any detrimental
affects on persons living or working in the area. Although the
proposed facility is near a major airport, the helistop has received
all necessary approvals from the Federal Aviation Administration
and Orange County Airport Land Use Commission to operate.
F. Will the proposed use adversely affect the present economic stability or
future economic development of property in the surrounding area?
The proposed helistop, which is an ancillary service that will be
utilized a maximum of three times per week, is not anticipated to
have any negative or detrimental impacts on the economic viability
of the surrounding area. The helistop will be located on top of an
existing building and should not impact the operations of the Auto
Mall.
G. Will the proposed use comply with the regulations and conditions specified
in the chapter of the Santa Ana Municipal Code for such use?
As conditioned, the helistop will comply with all regulations and
conditions specified in the Santa Ana Municipal Code, the Federal
Aviation Administration and the Orange County Airport Land Use
Commission.
• H. Will the proposed use affect the General Plan of the City?
The proposed facility will not pose any adverse affects on the
General Plan designation of Industrial (IND). The proposed
helistop is permitted in the district subject to approval of a
conditional use permit.
Section 2. The Planning Commission of the City of Santa Ana after conducting
the public hearing hereby approves and adopts the Mitigated Negative Declaration and
the Mitigation Monitoring Program for Environmental Review No. 01-118.
Section 3. The Planning Commission of the City of Santa Ana after conducting
the public hearing hereby approves Conditional Use Permit No. 01-29 as conditioned in
Exhibit "A" attached hereto and incorporated herein, and approves Site Plan Review No.
01-12.

• Conditions for Approval for Conditional Use Permit No. 01-29
Conditional Use Permit No. 01-29 is approved subject to compliance to the reasonable
satisfaction of the Planning Manager, with al{ applicable sections of the Santa Ana
Municipal Code the California Administrative Code, the Uniform Fire Code, the Uniform
Building Code, and all other applicable regulations.
The applicant must comply in full with each and every condition listed below rip or to
exercising the rights conferred by this conditional use permit.
The applicant must remain in compliance with all conditions listed below throughout the life
of the conditional use permit. Failure to comply with each and every condition may result
in revocation of the conditional use permit.
A. Planning Division
The helistop shall be used for private use of the site operator.
2. The flight approach and departure path for the helistop must parallel nearby
freeways as permitted by air traffic control authorities.
• 3. The number of arrivals and departures for the helistop shall not exceed three
per week and 12 per month as required by the County of Orange Airport
Land Use Commission.
4. Flights shall not arrive before 8:00 a.m. or depart after 5:00 p.m. Monday
through Saturday, and arrive before 9:00 a.m. or depart after 5:00 p.m. on
Sunday.
5. Prior to approval of the conditional use permit, provide documentation of the
approval of a State Heliport Permit by the Division of Aeronautics.
6. The landing area established at a height of 113 feet above mean sea level is
operated for private use only as required by the Federal Aviation
Administration.
7. Operations are to be conducted at this facility only during Visual Flight Rule
(VFR) conditions as required by the Federal Aviation Administration.
8. The landing area operator shall ensure and maintain obstruction free routes
of ingress and egress to the landing area as required by the Federal Aviation
Administration.

9. Coordinate all operations (approach/departure) with the Airport Traffic
Control Tower (ATCT) at John Wayne (Santa Ana) Airport as required by the
Federal Aviation Administration.
10. The flight path approaching/departing the proposed helistop from the north
or south shall not fly over the property boundaries of any schools or other
places of high densities of people such as residential areas as required by
the Federal Aviation Administration.
11. The helistop shall be made available to the City of Santa Ana and other
government agencies for emergency helicopters.
12. This Conditional Use Permit will be reviewed by the Planning Commission
within six (6) months to determine compliance with these conditions.
