A RESOLUTION OF THE ZONING ADMINISTRATOR
OF THE CITY OF SANTA ANA APPROVING MINOR
EXCEPTION N0.2001-01 TO ALLOW A THREE FOOT
HIGH FENCE IN THE FRONT YARD OF THE
PROPERTY LOCATED AT 1904 NORTH FLOWER
STREET
WHEREAS, Minor Exception No. 2001-01 came before the Zoning Administrator for a
public hearing on June 20, 2001, to permit a three foot high fence in the front yard of the property
located at 1904 North Flower Street, Santa Ana;
NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR
OF THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the above said hearing the Zoning Administrator
finds and determines as follows:
A. That because of special circumstances applicable to the subject property, including size,
shape, topography, location, or surroundings, the strict application of the zoning ordinance
is found to deprive the subject property of privileges not otherwise at variance with the
• intent and purpose of the provisions of this chapter.
Special circumstances exist in that the fence is built along the side property line,
where site visibility and emergency access will not be impeded.
B. That the granting of a minor exception is necessary for the preservation and enjoyment of
one or more substantial property rights.
The granting of Minor Exception No. 2001-01 will preserve and secure the rights of
the property owner for the enjoyment of property without undue concern, as the
fence has been constructed and cited by code enforcement.
C. That the granting of a variance will not be materially detrimental to the public welfare or
injurious to surrounding property.
The fence is a decorative polyvinyl picket fence with posts spaced at eight foot
intervals. The materials are compatible with the surrounding architecture and
consistent with existing neighborhood fences. The fence will not be detrimental and
injurious to surrounding property.
D. That the granting of a variance will not adversely affect the General Plan of the City.
