RESOLUTION NO. 01- 27
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF SANTA ANA APPROVING CONDITIONAL USE
PERMIT NO. 2001-19 TO PROVIDE A PARKING LOT
LOCATED AT 504-510 SOUTH CYPRESS IN THE R2B
ZONING DISTRICT
BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF
SANTA ANA AS FOLLOWS:
Section 1. The Planning Commission does hereby find, determine and declare as
follows:
A. Conditional Use Permit No. 2001-19 has been filed with the
City of Santa Ana seeking to allow a parking lot for the property located at 504-
510 South Cypress, in the City of Santa Ana, as a conditional use.
B. Santa Ana Municipal Code Section 41-638 authorizes the
Planning Commission to grant a conditional use permit upon making certain
findings.
C. The Planning Commission held a duly noticed public hearing on
June 25, 2001, for Conditional Use Permit No. 2001-19, and approved the Conditional
Use Permit No. 2001-19 with certain conditions.
D. At the July 16, 2001 City Council Meeting, the City Council
referred Conditional Use Permit No. 2001-19 back to the Planning Commission to
revise a condition pursuant to Santa Ana Municipal Code Section 41-642.
E. The Planning Commission held another duly noticed public
hearing on August 27, 2001, for Conditional Use Permit No. 2001-19.
Section 2. The Planning Commission approves Conditional Use Permit No.
2001-19 as conditioned in Exhibit "A" attached hereto and incorporated herein.
Section 4. The Planning Commission. makes and adopts the written findings of
fact attached hereto as Exhibit "B" and incorporated herein, in rendering its decision to
approve Conditional Use Permit No. 2001-19.

CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT NO. 2001-19
Should Conditional Use Permit No. 2001-19 be approved, the project shall comply with
all applicable sections of the Santa Ana Municipal Code, the California Administrative
Code, the Uniform Fire Code, the Uniform Building Code and all other applicable
regulations.
The applicant must comply in full with each and every condition listed below rip or to
exercising the rights conferred by this conditional use permit.
The applicant must remain in compliance with all conditions listed below throughout the
life of the conditional use permit. Failure to comply with each and every condition may
result in the revocation of the conditional use permit.
A. Planning Division
1. All proposed site improvements, including all landscaping, must conform
to the site plan review approval of DP No. 00-81 and the approved
landscape plan.
• 2. Any amendment to this conditional use permit must be submitted to the
Planning Division and Police Department for review. At that time, staff will
determine if administrative relief is available or the conditional use permit
must be amended.
3. The storage or repair of vehicles on the premises is prohibited, with the
property only to be used for the day-to-day parking of vehicles. The lot is
intended for customer and employee vehicles only. No vehicles shall be
stored overnight between the hours of 10:00 p.m. to 6:00 a.m. nor longer
than a 24 hour period.
4. A lot line adjustment must be completed to consolidate parcels 404-044-
02 and 404-044-03 commonly referred to as 504 and 510 South Cypress
Street.
5. The La Canasta Furnishings building and parking lot wall shall be painted
utilizing the color pallet approved for the South Main street redeye{opment
rebate program prior to the parking lot being finalized. (Added by the
Planning Commission at their meeting on June 25, 2001). The wall
color shall match the building and be approved by the Planning Division.

• B. Police Department
1. Solid wall height along Cypress Avenue is to be a maximum of 36 inches
to allow maximum patrol visibility.

FINDINGS OF FACT FOR CONDITIONAL USE PERMIT NO. 2001-19
A. Will the proposed use provide a service or facility which will contribute to the
general well being of the neighborhood or community?
The proposed parking lot for La Canasta Furnishings will provide
additional parking opportunities for a commercial business project that is
in an area currently short of parking. The new parking lot will eliminate
the need for customers to park off-site along Myrtle Street and Cypress
Avenue which will benefit the adjacent residential neighborhood.
B. Will the proposed use under the circumstances of the particular case be
detrimental to the health, safety or general welfare of persons residing or working
in the vicinity?
The proposed parking lot has been designed to minimize impacts to
surrounding residential uses. Landscape and fencing buffers have been
provided adjacent to residential property. In addition, lighting has been
designed to not exceed 15 feet in height and to shine away from
residential property. In addition, vehicular access is not permitted on
• Cypress Avenue, which will also minimize adverse impacts to persons
residing or working m the vicinity.
C. Will the proposed use adversely affect the present economic stability or future
economic development of properties surrounding the area?
The development of the site with a parking lot will enhance the economic
viability of the area as this use will develop two vacant parcels and
provide much needed parking for the furnishing store adjacent to the
proposed parking lot.
D. Will the proposed use comply with the regulations and conditions specified in
Chapter 41 of the Santa Ana Municipal Code for such use?
The proposed parking lot will meet and exceed all applicable provisions of
Chapter 41 of the Santa Ana Municipal Code, including landscaping,
setbacks and circulation.
E. Will the proposed use adversely affect the General Plan or any specific plan of
the City?

The proposed project will not adversely affect the General Plan as an
ancillary use such as a parking lot is permitted within the Low Density
residential (LR-7) designation.
