HomeMy WebLinkAbout2000-72• RESOLUTION NO.00-72 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING ADDITIONAL CANOPY SIGNAGE AND DENYING NEW FREESTANDING SIGNS AT THE SUPER WAREHOUSE GROCERY STORE LOCATED AT 1720 EAST SEVENTEENTH STREET WHEREAS, the applicant seeks relief from the sign requirements of Santa Ana Municipal Code Sections 41-863(a), 41-862(b), and 41-862(c)(2) in order to install three new secondary canopy signs on the primary building at 1720 East Seventeenth Street, to reduce the required landscaped setback around each freestanding sign by a minimum of one foot, and to allow signs that exceed seven feet in height, sixteen feet in overall width, and forty five square feet of face area; WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code, upon making certain findings; and WHEREAS, this Commission held a public hearing on February 12, 2001, on Variance • Application No. 00-68, for relief from certain provisions of the sign code. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the above said hearing this Commission finds and determines as follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, that the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. Due to the relative size of the lot and the setback of the building from the street, the installation of additional signage will allow Superior Warehouse the ability to identify goods and services available within the store. The variance will also allow Superior Warehouse the ability to use the property in a manner that is consistent with similar sized uses. The freestanding sign variances are not necessary as no special circumstances exist on the site that deprive the site of privileges. Other similar sized projects along the East Seventeenth Street have installed signage that is in compliance with the Sign • 1 • Code. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights. The granting of the variance for secondary signage will allow the tenant the ability to identify three departments or services that will be provided within the store. The variances for freestanding signage are not necessary to preserve property rights as the tenant will still be able to install new conforming signs, which provide adequate business identification. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property. The three additional canopy signs will not be detrimental to the surrounding area as a condition of approval has been added that will limit the amount of secondary signage allowed on the site. This will assist in minimizing the visual clutter found on structures with multiple wall signs. The granting of the variances for the freestanding signage may be detrimental to the area by allowing excessively large signage, not enjoyed by other properties, on the • site, which may contribute to adverse aesthetic impacts along the street. D. That the granting of a variance will not adversely affect the General Plan of the City. The granting of the variances will not adversely affect the City's General Plan in any way as the land use designation of General Commercial (GC) allows signage in conjunction with retail uses in the land use designation. 2. In addition, it shall meet the following conditions of approval: The applicant must comply with each and every condition listed below rior to exercising the rights conferred by this variance. The applicant must remain in compliance with all conditions listed below throughout the life of the variance. Failure to comply with each and every condition may result in the revocation of the variance. A. Planning Division 1. Compliance with the provisions of the Approved Sign Program No. • SPG 00-006 with the exception of the items covered by the variance. 2. The content of each secondary wall sign panel shall be limited to one item of information.
