HomeMy WebLinkAbout2000-43• RESOLUTION NO.00-43 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO.00-22 TO ALLOW A TYPE 41 ALCOHOL BEVERAGE CONTROL LICENSE FOR ON-PREMISES CONSUMPTION OF BEER AND WINE AT TAQUERIA DE ANDA RESTAURANT, LOCATED AT 1029 EAST FOURTH STREET WHEREAS, Conditional Use Permit No. 00-22 came before the Zoning Administrator for a public hearing on November 15, 2000, to allow a Type 41 Alcohol Beverage Control License for on-premises consumption of beer and wine at Taqueria De Anda Restaurant, located 1029 East Fourth Street, Santa Ana; and WHEREAS, following said public hearing, the Zoning Administrator determined to approve Conditional Use Permit No. 00-22, subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator • finds and determines as follows: A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or the community? The proposed restaurant will provide a service to the community by providing dining service at a bona fide eating establishment. The on-premise alcoholic beverage license will be in compliance with the established guidelines for restaurants selling alcoholic beverages to avoid the potential of nuisance being attracted to this location. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity? The proposed on-premise beer and wine license will not be detrimental to persons residing and working in the area as the use since the sale of alcoholic beverages will occur inside of the premise and is incidental to the restaurant use. C. Will the proposed use adversely affect the present economic stability or future economic development of properties surrounding the area? • 1 • The restaurant is freestanding, which is suitable for the proposed use. The on- premise beer and wine license is expected to bring additional patrons to the restaurant and adjacent business, which will benefit the economic stability of the surrounding area. D. Will the proposed use comply with the regulations and conditions specified in Chapter 41 for such use? The proposed project will be in compliance with all applicable conditions of Chapter 41 of the Santa Ana Municipal Code regarding on-premise beer and wine license. E. Will the proposed use adversely affect the General Plan or any specific plan of the City? The proposed project will not adversely affect the General Plan. Restaurant and ancillary uses such as on-premise beer and wine license are permitted within the Industrial (IlVD) land use designation. The proposed project is not located in the specific plan area in the City. 2. Conditional Use Permit No. 00-22 is hereby approved, subject to conditions, as set forth in Attachment A, attached hereto and incorporated herein. ADOPTED this ~~ day of Nnveml,Pr , 2QQp.
