HomeMy WebLinkAbout2000-39• RESOLUTION NO. 2000-39 Kdo/1 /28/02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 00-09 FOR RELIEF FROM THE REQUIRED SETBACK REQUIREMENTS FOR AN OFFICE BUILDING LOCATED AT 4010 WEST CHANDLER AVENUE BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The Planning Commission of the City of Santa Ana hereby finds, determines and declares as follows: A. The Planning Commission held a duly noticed public hearing on October 23, 2000, on Variance No. 00-09, for relief from Santa Ana Municipal Code Section 41-475 at 4010 West Chandler Avenue • B. In accordance with the California Environmental Quality Act, the proposed project is exempt from further review. Categorical Exemption Environmental Review No. 00-60 will be filed for this project. C. Santa Ana Municipal Code Section 41-638 authorizes the Planning Commission to grant a variance upon making certain findings. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, that the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of this chapter. Due to the need of the road to elevate and cross over the Santa Ana River, access and egress onto Segerstrom Avenue is restricted. Due to this special circumstance, the strict application of the setback requirement would result in a loss of outdoor storage area needed for the operation of the contracting business. The reduced setback will be mitigated through the addition and upgrading of landscaped materials within the setback. 2. That the granting of a variance is necessary for the preservation and • enjoyment of one or more substantial property rights. Resolution No. 2000-39 Page 1 of 3 • The granting of the setback variance will allow the applicant the ability to expand the headquarters function of the business whsle continuing to allow the use of the rear area as a storage facility. 3. That the granting of a variance will not be materially detrimental to the public welfare or injurious to surrounding property. The variance for the street setback will not be detrimental to the surrounding area as the setback will be landscaped to be compatible with the setbacks of the surrounding buildings. Additionally, the setback slopes away from the street and will be minimally visible to persons traveling on Segerstrom Avenue. 4. That the granting of a variance will not adversely affect the General Plan of the City. The granting of the variance will not adversely affect the City's General Plan in any way as the land use designation of Industrial (IND) allows the construction of ancillary office uses in conjunction with permitted industrial uses. • Section 2. The Planning Commission hereby approves Variance No. 00-09 as conditioned in Exhibit "A" attached hereto and incorporated herein. ADOPTED this 23rd day of October, 2000. The applicant must comply in full with each and every condition listed below rip or to exercising the rights conferred by this conditional use permit. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in revocation of the conditional use permit. A. Planning Division 1. The applicant must comply with the exhibits contained in this report and all requirements from the Development Review Committee for this development project (DP No. 00-20). B. Police Department 1. The existing building and parking lot must conform with the provisions of the Building Security Ordinance. This will require the project's lighting, door and window locking devices, and addressing be upgraded to current code standards. • EXHIBIT "A"
