HomeMy WebLinkAbout2000-16RESOLUTION NO. 00-16 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING CON- DITIONAL USE PERMIT NO. 00-OS TO PERMIT CONSTRUCTION OF A CHURCH AT 1100 SOUTH CENTER WHEREAS, Santa Ana Municipal Code Section 41-232.5 permits construction of churches and accessory church buildings in a R-1 zone district, subject to a conditional use permit; and WHEREAS, this Commission held a public hearing on Apri124, 2000, on Conditional Use Permit Application No. 00-05, to allow construction of a church, located in a R-1 zone, at 1100 South Center. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and determines as follows: A. That the granting of a Conditional Use Permit is necessary for the preservation and enj oyment of one or more substantial property rights; The proposed church and parish facility, as conditioned, provides community service and ministries, contributing to the long-term success of the neighborhood. The Immaculate Heart parish has identified a substantial need for an additional church capacity. Conditions of approval have been developed in order to mitigate potential impacts of a larger church on this site. These include the limiting of facility use on the premises to ensure shared parking occurs and the upgrading of landscaping on the site to exceed the square footage required by development standards. The project allows the continuation of the existing parish activities while lessening on-site and off site impacts of a vibrant parish. B. That the granting of a Conditional Use Permit will not be materially detrimental to the public welfare or inj urious to surrounding property; The addition of a new 1200 seat church, renovation of the property, and conversion of the current church into a parish hall, as conditioned, will not impact or be detrimental to the overall site or neighborhood. Site improvements will be made to enhance the site and mitigate circulation impacts on-site and in the neighborhood, parking adequacy, safety issues, noise impacts and design concerns. C. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area? The proposed church and ancillary facilities should not adversely affect the present and future economic stability of property in the surrounding area. The church and its design, as conditioned, provide visual improvement to the area. The economic viability of the area should not be decreased. As conditioned, the project should not have any impacts on the economics of the area. D. Will the proposed church comply with the regulations and conditions specified in the Santa Ana Municipal Code Section 41-41.5 for such a use? As conditioned and with Variance No. 00-002 for shared parking with a parking reduction, and a landscaping trade-off, the proposed facility complies with the zoning code, and design standards for such uses. E. Will the proposed use adversely affect the General Plan of the City or any specific plan applicable to the area of the proposed use? The church and school at this location are consistent with the General Plan. The proposed activities on the site and zoning are consistent with the General Plan of Santa Ana. 2. Conditional Use Permit No. 00-OS is hereby approved as conditioned in Attachment A, attached hereto and incorporatedherein. RESOLUTION NO. 00-16 APRIL 24, 2000 PAGE 1 OF 2 Conditions of Approval Conditional Use Permit No. 00-05 is approved subject to compliance, to the reasonable satisfaction of the Planning Manager, with all applicable sections of the Santa Ana Municipal Code, the California Administrative Code, the Uniform Fire Code, the Uniform Building Code, and all other applicable regulations. The applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this Conditional Use Permit. A. Planning Division 1. The applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 2. There shall be no more than 1,200 seats or occupancy of the church at any time. 3. The parish will remove graffiti occurring on the property within 48 hours and clean up litter on and about the site within three hours of an assembly activity. 4. The use of the property is limited to a church, a school, and related parish buildings and activities. No thrift shops, food distribution program, nor rehabilitation programming may occur out of the premises, nor may there be outside pushcart or other vendors vending from the premises. 5. All new trees in the required front landscape setback abutting streets shall be 24-inch box size or larger. 6. After project occupancy, landscaping is to be maintained to include the minimum levels of plant materials to be installed at the time of occupancy. 7. Public payphones, if provided, may only be located within buildings or in the interior of the site. ATTACHMENT A RESOLUTION NO. 00-16 APRIL 24, 2000 PAGE 2 OF 2 B. Police Department 1. The existing buildings and parking lot lighting must conform to the provisions of Chapter Eight, Article II, Division Three of the Santa Ana Municipal Code (Building Security Ordinance). These code conditions will require that the existing project's lighting, door/window locking devices, and addressing be upgraded to current code standards. Lighting standards cannot be located in required landscape planters.
