A RESOLUTION OF THE ZONING ADMINISTRATOR
OF THE CITY OF SANTA ANA APPROVING
CONDITIONAL USE PERMIT NO. 00-04 TO ALLOW
A TYPE 41 ALCOHOL BEVERAGE CONTROL
LICENSE FOR ON-PREMISES CONSUMPTION OF
BEER AND WINE AT THE EL REY de MARISCOS
RESTAURANT, LOCATED AT 501 NORTH HARBOR
BOULEVARD, SUITE E
WHEREAS, Conditional Use Permit No. 00-04 came before the Zoning Administrator for a
public hearing on April 5, 2000, to allow a Type 41 Alcohol Beverage Control License for on-
premises consumption of beer and wine at the El Rey de Mariscos Restaurant, located 501 North
Harbor Boulevard, Suite E, Santa Ana; and
WHEREAS, following said public hearing, the Zoning Administrator determined to
approve Conditional Use Permit No. 00-04, subject to conditions.
NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator
finds and determines as follows:
A. Will the proposed use provide a service or facility, which will contribute to the general
well being of the neighborhood or community?
The sale of beer and wine for on-premise sale and consumption, as conditioned, will
provide a service to restaurant patrons by providing the opportunity to select
alcoholic beverages with the food service.
B. Will the proposed use under the circumstances of the particular case be detrimental to the
health, safety or general welfare of persons residing or working in the vicinity?
The proposed Type 41, ABC license will not be detrimental to the surrounding
businesses or residents since the service of alcoholic beverages is in conjunction
with food service and must be consumed within the restaurant premise. The
proposed conditions are designed to ensure the restaurant remains abona-fide eating
establishment.
C. Will the proposed use adversely affect the present economic stability or future economic
development of property in the surrounding area?

The restaurant provides a service to the surrounding commercial and industrial
businesses. The on-premise sale of alcoholic beverages at the El Rey de Mariscos
Restaurant affords the dining patrons a choice of beverages. It is not anticipated that
alcoholic beverage service will adversely affect the economic future of the area.
D. Will the proposed use comply with the regulations and conditions specified in the chapter of
the Santa Ana Municipal Code for such use?
The proposed Alcoholic Beverage License, as conditioned, will comply with all
regulations, conditions and requirements specified in the Santa Ana Municipal Code
pertaining to the sale of alcoholic beverage for on-premise sale and consumption in
a bona-fide eating establishment. The restaurant meets the kitchen equipment
requirement and the proposed alcoholic beverage storage and display area does not
exceed the maximum five percent.
E. Will the proposed use adversely affect the General Plan of the City?
The proposed sale of alcoholic beverages for on-premise sale and consumption
will not affect the General Plan designation of General Business District. The sale
and consumption of alcoholic beverages is incidental to the restaurant's food
service operation, a permitted commercial activity in the General Business
District designation.
2. Conditional Use Permit No. 00-04 is hereby approved, subject to conditions, as set forth
in Attachment A, attached hereto and incorporated herein.
