RESOLUTION NO. 99-28
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING
VARIANCE NO. 99-07, FOR RELIEF FROM
CERTAIN PROVISIONS OF THE SIGN CODE
RELATED TO OVERALL HEIGHT, LINEAL
FOOTAGE AND SIGN AREA OF A MONUMENT
SIGN LOCATED AT 4505 WEST FIRST STREET
WHEREAS, Santa Ana Municipal Code Section 41-638 provides for
the granting of a variance from the provisions of the Santa Ana
Municipal Code, upon making certain findings; and
WHEREAS, this Commission held a public hearing on July 12,
1999, on Variance Application No. 99-07, for relief from the sign
code for height, lineal footage and sign area.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing this Commission finds and determines as follows:
A. That because of special circumstances applicable to the
subject property, including size, shape, topography,
location or surroundings, the strict application of the
zoning ordinance is found to deprive the subject property of
privileges not otherwise at variance with the intent and
purpose of the provisions of the Municipal Code;
The approval to allow the monument sign to exceed the
maximum height, lineal footage and sign face area would
not jeopardize the intent of the sign code. as
conditioned, the site would be limited in the number
and types of signs, therefore reducing sign clutter a
goal of the sign code.
B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial
property rights;
As conditioned, the variance will limit the number of
overall signs on the site. Approval of the variance
does not prohibit the identification of the business in
an aesthetically appealing manner. Allowing a larger
monument sign while reducing the number of overall
signs on the site help to maintain an attractive gas
station site.

C. That the granting of a variance will not be materially
detrimental to the public welfare or injurious to
surrounding property;
Granting a variance, as conditioned, will not be
detrimental to the public and surrounding properties by
allowing the proposed signage to exceed the size limits
for monument signs. The approval of the monument sign
requires the applicant to remove a number of signs on
the subject site. It also prohibits the applicant from
installing or advertising any additional signs. The
reduction of signs. will visually enhance the service
station property and the surrounding visual
environment.
D. That the granting of a variance will not adversely affect
the General Plan of the City;
The granting of the variance as conditioned will not
adversely affect the City's General Plan land use
designation for the area.
2. Variance No. 99-07 is approved, as conditioned, based
upon the aforementioned findings.

Variance No. 99-07 is approved subject to compliance, to the reasonable
satisfaction of the Planning Manager, with all applicable sections of the
Santa Ana Municipal Code, the California Administrative Code, the Uniform
Fire Code, the Uniform Building Code and all other applicable regulations.
The applicant must comply in full with each and every condition listed
below prior to exercising the rights conferred by this site plan review
approval.
The applicant must remain in compliance with all conditions listed below
throughout the life of the development project. Failure to comply with
each and every condition may result in the revocation of the site plan
review approval.
Conditions of Approval
A. Planning Division
1. No other signs or displays of any kind, including but not
limited to additional price signs, Chevron logos and
identification, banners, flags, pennants, streamers, window
signs, sale signs, advertisements, spandrel (spanner) signs,
advertising boxes on light standards, car wash or other
vehicular directional signs, etc. will be permitted. Only those
identified in a through e below are allowed:
a) One monument sign (freestanding) sign which includes the
"Chevron" logo, the words "Fast Pay", gasoline and diesel
fuel pricing, and the address. The monument sign not exceed
13 feet 2 ~ inch in overall height, 18 feet 10 ~ inches in
lineal feet and 49 square feet of advertising area.
b) One "Chevron" sign located on the south elevation of the
canopy.
c) One small "Chevron" logo located on the east elevation of
the canopy.
d) One "Food Mart" sign over the entrance to the building.
e) Six "Self" signs located on the edge of the spandrels.

2. Place the freestanding monument sign in a diagonal direction to
allow price visibility from First and Newhope Streets. Also,
provide 4 feet of landscaping around the entire monument sign.
3. Remove the unpermitted exterior telephones from the site or
apply for an Exterior Telephone Land Use Certificate.
4. Remove the unpermitted air/water unit from the site or provide a
parking space for the designating air/water location.
5. Provide a 5-foot landscape planter along the northerly and
westerly property lines. Restripe the parking spaces along the
northerly property line to comply with the added landscaping
planter. Submit a landscape plan for approval by the Planning
Division. Install and maintain the landscaping per the approved
landscape plan.
6. A Land Use Certificate is required for the roof mounted dish
antenna.
7. Existing monument sign to be removed from service station
property. Also, remove the Point of Sale (POS) signs as noted
on Exhibit 3.
8. Provide a trash enclosure on the service station site. Trash
enclosure is to be built to City specifications.
