NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Commission finds and determines as follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code; The granting of a variance, as conditioned, will allow the monument sign to exceed sign limits, while limiting any additional signs on-site. The limitations for signage are in harmony with the intent of the sign code to reduce sign clutter. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights; Approval of the monument sign variation, as conditioned, would not prohibit the identification of the business in an aesthetically appealing manner. The conditions of approval help to offset the size of the monument sign by limiting the number of signs. C. That the granting of a variance will not be materially detrimental to the public welfare or injurious to 1 • • surrounding property; Granting a variance as conditioned will not be detrimental to the public and surrounding properties by allowing the proposed signage to exceed the size limits for monument signs. The approval requires the applicant to remove a number signs on the subject site. It also prohibits the applicant from installing or advertising any additional signs. The conditions of approval, limiting additional signage will visually enhance the service station property and the surrounding visual environment. D. That the granting of a variance will not adversely affect the General Plan of the City; The granting of the variance as conditioned will not adversely affect the City's' General Plan land use designation for the area. 2. Variance No. 99-05 is hereby approved, as conditioned, based upon the aforementioned findings.
