A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF SANTA ANA APPROVING CON-
DITIONAL USE PERMIT NO. 97-20 TO PERMIT
AN OFFICE IN EXCESS OF 30 PERCENT OF
THE FLOOR AREA AT 3400 WEST SEGERSTROM
AVENUE

WHEREAS, this Commission held a public hearing on February 9,
1998, on Conditional Use Permit Application No. 97-20, to allow an
office in excess of 30 percent of the floor area in a Light
Industrial (Ml) zoning district, for BEHR Process Corporation,
located at 3400 West Segerstrom Avenue;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF SANTA ANA AS FOLLOWS:
1. Based upon the evidence submitted at the abovesaid
hearing, this Commission finds and determines as follows:
A. That the proposed use will provide a service or facility
which will contribute to the general well being of the
neighborhood or the community.
The amount of office space will reduce the number of
unnecessary truck trips that can be burdensome to the
existing infrastructure. It will also relieve traffic
in and around the site as loading functions will be
limited to one facility.
B. Will the proposed use under the circumstances of the
particular case be detrimental to the health, safety, or
general welfare of persons residing or working in the
vicinity?
The proposed use will not be detrimental to the health
and safety of the surrounding area. The project will
minimize traffic hazards normally affiliated with the
mixture of car and truck trips.
C. Will the proposed use adversely affect the present economic
stability or future economic development of properties
surrounding the area?
The project will enhance the economic viability of the
immediate area by providing the opportunity for an
existing corporation to correct a processing problem to
the ultimate benefit of employment considerations.

D. Will the proposed use comply with the regulations and
conditions specified in Chapter 41 for such use?
Upon receiving an approval for a conditional use
permit, the project will comply with the requirements
specified in Chapter 41 of the Santa Ana Municipal
Code.
E. Will the proposed use adversely affect the General Plan or
any specific plan of the City?
The proposed project is in compliance with the
Industrial District (IND) land use designation of the
General Plan. This district permits the office use as
proposed with the approval of a conditional use permit.
2. Conditional Use Permit No. 97-20 is hereby approved as
conditioned in Attachment A, attached hereto and incorporated
herein.
