HomeMy WebLinkAbout1997-12RESOLUTION NO. 97- }2 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT N0. 97-15 TO ALLOW A TYPE 41 ALCOHOL BEVERAGE CONTROL LICENSE FOR ON-PREMISES CONSUMPTION AT DOS AMIGOS RESTAURANT, LOCATED AT 3701 WEST MCFADDEN AVENUE WHEREAS, Conditional Use Permit No. 97-15 came before the Zoning Administrator for a public hearing on August 27, 1997, to allow a Type 41 Alcohol Beverage Control License for on-premises consumption at Dos Amigos Restaurant, located 3701 West McFadden Avenue; and WHEREAS, following said public hearing, the Zoning Administrator determined to approve Conditional Use Permit No. 97- 15, subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator finds and determines as follows: A. Will the proposed use provide a service or facility which will contribute to the general well being of the neighborhood or community? The sale of beer and wine for on-premise consumption, as conditioned, will provide a service to restaurant patrons by providing the opportunity to consume alcoholic beverages associated with normal dining activities. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? An alcohol license, as conditioned, at the proposed Dos Amigos No. 2 Restaurant is not anticipated to have a detrimental affect to the persons residing or working in the area. The sale of alcohol at the facility will be an ancillary service for the patrons of the restaurant. C. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area? • The ancillary service of on-premise sales of beer and 1 wine, as conditioned, is not anticipated to have adverse impacts on the economic stability of future economic development of .the surrounding area. The provision of this additional service should increase sales, thereby strengthening the viability of this enterprise. D. Will the propose use comply with the regulations and conditions specified in the chapter of the Santa Ana Municipal Code for such use? The proposed Alcohol Beverage Control License complies with all regulations and conditions specified in the Santa Ana Municipal Code pertaining to an alcoholic beverage licensed establishment. Will the proposed use adversely affect the General Plan of the City? The proposed sale of alcoholic beverages for on-premise consumption will not have an adverse affect on the General Plan designation of the General Business District (GBD). The sale of alcoholic beverages is incidental to the restaurant use which is permitted in the district. 2. Conditional Use Permit No. 97-15 is hereby approved, subject to conditions, as set forth in Attachment A, attached hereto and incorporated herein.
